Özet
İnşaatlar sosyo-ekonomik nedenlerden dolayı yaygın şekilde arsa payı karşılığı inşaat sözleşmesiyle meydana getirilmekte olup en sık rastlanan hukuki ihtilaflar ise müteahhidin içinde bulunduğu mali durum sebebiyle inşaatı eksik bırakması veya geç teslim etmesidir. Diğer bir değişle tezimizin konusu olan teslim borcuna aykırılık sebebiyle temerrüt haline ilişkindir. Ancak bu alana ilişkin müstakbel bir düzenleme bulunmamakta olup eser ve satış vaadi sözleşmesi ile TBK genel hükümleri ile yetersiz kalmaktadır. Bilindiği üzere eserimizin konusu olan alan genel anlamda Türk borçlar kanunu genel hükümler, eser sözleşmesi ve taşınmaz satış vaadi sözleşmesi hükümleri uyarınca oluşturulan doktrin görüşleri ve yargıtay içtihatları ile şekillenen bir alandır. Bu sebeple eserin meydana getirilmesi aşamasında mümkün olduğunca çeşitli sayıda eser irdelenmeye çalışılmış ve uygulamada benimsenmiş, uygulama ile ters düşmeyecek doktrin görüşleri ile birlikte yerleşik hale gelmiş yargıtay kararlarına yer verilmeye özenle gayret edilmiştir. Bu bağlamda tezimizde yüklenicinin teslim borcuna aykırılığından doğan temerrüt sebebiyle çıkan hukuki ihtilaflara çözüm sunmakla birlikte bu hususa ilişkin açıklamaların uygulamayla örtüşen, sade, anlaşılır bir yol haritası mahiyetine haiz olabilmesi amaçlanmıştır.

Due to socio-economic reasons, constructions are commonly made with construction contracts in return for land share, and the most common legal disputes are the contractor's incomplete or late delivery of the construction due to the financial situation s/he is in. In other words, the subject of our thesis is on the law default due to non-compliance with the delivery obligation. However, there is no would-be regulation regarding this area, and the general provisions of the TCO, and the contract of construction and preliminary sales are insufficient. As it is known, the field that is the subject of our work is a field that is shaped by the doctrinal views and jurisprudence of the Supreme Court created in accordance with the general provisions of the Turkish Code of Obligations, the contract of work and preliminary sales of real estate. For this reason, at preparation stage of this work, it was tried to examine as many works as possible and the decisions of the Supreme Court were included, which were adopted in practice and became settled with doctrinal views that would not contradict the practice. In this context, in our thesis, it has been aimed to provide solutions to legal disputes arising due to law default arising from the contractor's breach of delivery debt, and provide a simple, understandable road map that overlaps with the application.
