Özet
Bu çalışmanın amacı, Türk Patent Enstitüsü tarafından tescile konu olan coğrafi işaretlerden, gıda kapsamında değerlendirilen ürünlerin tescil belgelerinin incelenerek, tescil sürecinde yaşanan sorunların belirlenmesi ve öneriler geliştirilmesidir. Gıda ürünlerinin ele alınmasındaki amaç, hem tescili talep edilen ürün sayılarının fazla olması hem de söz konusu ürünlerin ayırt edici özelliklerinin sistematiklikten yoksun olmasıdır. Bu amaçla, Türk Patent Enstitüsü tarafından tescile konu olan coğrafi işaret kapsamındaki ürünlerin tescil belgeleri, nitel araştırma yöntemlerinden biri olan doküman incelemesi yöntemiyle analiz edilmiştir. Coğrafi işaretlerin ilk olarak tescillenmeye başladığı 1996 yılından 2014 yılına kadar Türk Patent Enstitüsü tarafından tescil edilmiş 180 coğrafi işaretten gıda kapsamında değerlendirilen 123 ürünün tescil belgeleri türleri, coğrafi sınırları, ayırt edici nitelikleri, denetim yetkisi, denetleme kriterleri ve süreleri açısından 555 sayılı Coğrafi İşaretlerin Korunması Hakkında Kanun Hükmünde Kararnameye uygunluğu bağlamında analiz edilmiştir. Ayrıca çalışmada dava konusu olan 4 coğrafi işarette incelemeye tabi tutulmuştur. Araştırma sonucunda coğrafi işaret kavramının yeterli düzeyde bilinmediği, coğrafi işaret tesciline önem verilmediği, tescile konu olan ürünlerin özensizce tescillendiği ve tescil belgelerinde belirli bir standarttın olmadığı tespit edilmiştir.

Purpose of this study is to identify the problems occurring in the process of registration and to propose solutions to these problems, by examining the registration certificates of products that are classified as food, among the other geographical signs that are registered by Turkish Patent Institute. Food products are discussed both because there is a considerable number of products that are requested to be registered, and because there is a lack of a systematic approach of the distinctive features of these products. For this purpose, registration certificates of products covered by geographical signs, which are subject to registration by the Turkish Patent Institute are analyzed with the method of document analysis, one of the qualitative research methods. The analysis is based on the suitability to The Decree-Law No.555 Pertaining To The Protection of Geographical Signs, in terms of audit criteria and period, audit authority, distinctive features, geographical boundaries, and types of registration certificates of 123 products that are classified as food products among 180 geographical signs, registered by Turkish Patent Institute from 1996, the year that geographical signs are started to be registered, until 2014. Furthermore, in this study 4 geographical signs that are litigated are analyzed as well. At the end of the research, it is revealed that knowledge on the concept of geographical signs is not adequate, that registration of geographical indications is not valued, and that the products covered for registration are registered carelessly. It is also observed that there is no standard for the registration documents.
