Özet
Tezimizin konusu, Kelamcı Fıkıh Usulcülerinin Nesih Anlayısıdır. Kelamcı Fıkıh Usulcülerinin, nesih anlayısını ortaya koymaya çalıstıgımız tezimiz, bir giris ve üç bölümden olusmaktadır. Giriste; tezin konusu, tezin amacı, tezin sınırlandırılması, tezin yöntemi ve tezin bölümleri hakkında bilgiler verilmistir. Birinci bölümde; neshin kelime ve ıstılahî anlamı, nesih ile tahsisin iliskisi, nesih ile bedâ iliskisi, neshin cevâzı, neshin vuku bulması, neshin rükünleri ve sartları ele alınarak nesih kavramı ve mahiyetinin ne oldugu ortaya konmaya çalısılmıstır. kinci bölüm ise; iki ana baslıktan olusmaktadır. Birinci ana baslık, deliller arası nesih iliskisidir. Bu ana baslık altında, âyetin bir baska âyetin hükmünü neshetmesi; sünnet ile âyetin hükmünün neshedilmesi; âyet ile sünnetin hükmünün neshedilmesi; sünnet ile sünnetin neshedilmesi; haber-i vahid ile mütevatir nassın hükmünün neshedilmesi; icma ile neshin gerçeklesmesinin mümkün olup olmadıgı; nassa kıyas ile sabit olmus hükmün nesih edilmesi ve sahabe sözü ile neshin gerçeklesmesinin mümkün olup olmadıgı ele alınmıstır. kinci ana baslıkta ise, Kur'an âyetlerinin nesih açısından tasnifi yapılmıstır. Bu ikinci ana baslık altında ise; hükmü mensuh tilaveti baki olan âyetler; hükmü baki tilaveti mensuh olan âyetler; hem tilaveti hem de hükmü mensuh olan âyetler konuları ele alınmıstır. Üçüncü bölüm ise, nesih ile ilgili konulardan olusmaktadır. Bu ana baslık altında, neshe konu olan hükümler; haber-i cümlelerin neshi, ebed lafzı ile mukayyed hükmün neshi; nass üzerine ziyadenin nesih olup olmadıgı; ibadetin bir cüzünün neshe konu olması; neshin tarihinin tespiti; hükmün nesih haberi kendisine ulasmamıs kimsenin nesih karsısındaki konumu alt baslıkları yer almaktadır.

Abrogation of understanding of the theologian Fiqh Methodologists This thesis is entitled ?Abrogation of understanding of the theologian fiqh methodologists? and consists of an introduction and three main chapters. In the introduction necessary information is given about the subject and aim of the thesis as well as its restriction, method and content of the chapters. In the first chapter meaning of the naskh (abrogation) and its technical meaning, naskhtakhsis relationship, naskh-bada relationship, permissibility of naskh, occurrence of naskh, its conditions and fundamentals were studied and by this we tried to define the concept of naskh its true nature. The second chapter consists of two sections.in the first one inter-evidences naskh relationship is studied. Topics such as abrogation of a Qur?anic verse by another, abrogation of a Qur?anic verse by a prophetical tradition and vice versa, abrogation of sunnah by another one, abrogation of a mutawatir text by khabar-i wahid, possibility of the occurrence of naskh by concensus or by the report of a companion of the prophet have been dealt with in this section.in the second section, a classification of the Qur?anic verses according to naskh was made and topics such as, abrogated verses with their recitation remaining, verses which their recitation is abrogated but their decree is remaining, verses, both their decree and recitation are abrogated are studied. In the third chapter we studied various topics related to the naskh.among them we can name, abrogation of the khabar sentences, abrogation of the eternal decree whether an addition to nass is considered as naskh or part of a prayer becoming a subject of naskh, determine the history of naskh, position of a person to whom the knowledge of the naskh has not reached.
