Özet
Bu çalışma İslam hukukunun sosyolojik temellerini vahiy öncesi ve vahiy dönemi ceza hukuku uygulamaları üzerinden incelemeyi ve tespit etmeyi amaçlamaktadır. Bu bağlamda ceza hukuku uygulamalarının sadece normatif gerçeklikleri değil, onların toplumsal bağlam içerisindeki konumları ve gerçekleştirmeyi istedikleri amaçlar ile bu amaçların dayandığı toplumsal ihtiyaçlar birlikte değerlendirilmiştir. Çalışmada had cezası verilen suçlar olarak nitelendirilen hırsızlık, zina, iftira ve yol kesme suçları ile kısas ve diyet gerektiren suçlar ele alınmıştır. Bu suçların önceki dini ve hukuki metinlerde, Câhiliye toplumunda ve vahiy döneminde nasıl cezalandırıldığı karşılaştırmalı olarak incelenmiş, aralarındaki farklılık ve aynılıklara, bu farklılaşmanın esas teşkil ettiği toplumsal değişimlere işaret edilmiştir. Bu doğrultuda her suç hem normatif karakteri ile hem de sosyolojik boyutuyla birlikte değerlendirilerek İslam ceza hukukunun toplumsal karakteri ortaya konmaya çalışılmıştır. Kavramsal çerçeveyi oluşturduğumu birinci bölümde hukuk, suç ve ceza kavramlarına, hukukun toplum ile ilişkisine, ceza hukukunun amaçları ve toplumsal otorite ile ilişkilerine değinilmiştir. Câhiliye döneminin genel bir fotoğrafını çekmeyi hedeflediğimiz ikinci bölümde ise dönemin toplumsal ve hukuki karakteristiği ve bunu oluşturan toplumsal bağlam ele alınmıştır. Üçüncü ve ana bölümümüzde ise İslam ceza hukukunda konu edinilen had ve kısas cezalarını gerektiren suçlar, tarihsel arka plan, Câhiliye dönemi ve vahiy dönemi uygulamaları üzerinden incelenmiştir.

This study aims to examine and identify the sociological foundations of Islamic law by focusing on criminal law practices during the pre-revelation and revelation periods. Within this framework, the research considers not only the normative dimensions of criminal law but also its place within the social context, the purposes it seeks to achieve, and the societal needs underlying these purposes. The study analyzes offenses that are subject to fixed punishments in Islamic law, such as theft, adultery, false accusation, and highway robbery, alongside crimes that necessitate retaliation or financial compensation. These offenses are examined comparatively with reference to earlier religious and legal texts, the practices of pre-Islamic society, and the period of revelation. The differences and similarities in their treatment across these contexts are highlighted, with attention paid to the social transformations reflected in these legal distinctions. Each offense is evaluated from both its normative and sociological dimensions in order to demonstrate the social character of Islamic criminal law. The first chapter establishes the conceptual framework by addressing the notions of law, crime, and punishment, as well as the relationship between law and society, the objectives of criminal law, and its connection to social authority. The second chapter aims to offer a general portrayal of the pre-Islamic period, focusing on its legal and social characteristics and the broader context that shaped them. The third and principal chapter examines the offenses subject to fixed and retaliatory punishments in Islamic law based on their historical background and their application during the pre-Islamic and revelation periods.
