94 ABSTRACT“Hanafî Jurist Burhanu'd-Dîn al-Marghinanî and His Work al-Hidâya”Mawarannahr has been one of the greatest centers of Islamic sciences. The Hanafî legal school which had developed at the period of Karakhanids (İlekhans) Dynasty in this region had a great importance in the history of Hanafî thought. Mawarannahrien faqihs (Islamic jurists) took a part in the process of adaptation islam according to the region's condition. Mawarannahrien jurists like Abu'I-Layth as-Samarkandî (d. 375/983), Fahru'd- Dîn Mahmud b. Ahmad al-Buharî (d. 570/1174-75), Fahru'd-Dîn Qadman (d. 592/1196), Burhanu'd-Dîn al-Marghinanî (d. 593/1 197) and etc. have been count in an high level with the greatest jurists of Hanafî madhhab (school). This master thesis consists of introduction, three sections, conclusion, addition part and bibliography. In the introduction the subject of the thesis and the importance of the research have been formulated. The first section gives information about political, economic and cultural situations in Mawarannahr and the process of formation, development and decadence of Hanafî legal school in Mawarannahr. In the second section the biography of Mawarannahrien jurist Burhanu'd-Dîn al-Marghinanî has re-composed basing on the informations derived from middle-ages Islamic books written on style“tabaqat”. Burhanu'd- Dîn al-Marghinanî was born in the village Rishtan near Farghana (placed on the territory of modern Uzbekistan). Marghinanî wrote many books relating to furu'u'1-fiqh (branches of Islamic law) and their copies are still kept in the different libraries of Turkey, in the archives of Orientalistic Enstitute of Uzbekistan Republic and in the libraies of many other countries. The most famous of his works was“al-Hidaya”written as a commentary to his another work“Kifayatu'l-Muntahi”the commentary to his another work“Bidayatu'l-Mubtadi”. Marghinani has been included to the fifth tabaqat (level)“ashab at-tarjîh”in Hanafi madhhab. In“al-Hidaya”which has been a handbook of Hanafî madhhab the point of view of authorities of another madhhab about subjects under discussion were given and compared, so the book is on the level of comparative law between schools (madhahib). As a conclusion, one of the greatest jurists of Hanafi legal school in Mawarannahr belonging to the period of Karakhanids Dynasty Burhanu'd-dîn al-Marghinanî played a part in formation and development of Hanafi madhhab in Mawarannahr. His work“al-Hidaya”had a great importance in the adaptation of islam to this region, in addition to this it has influenced the process of development of Hanafi thought in the countries of Moslem world. More than 60 commentaries in Arabic, Persian, Urdu and etc. were written to this book, which lately influenced the activity of the jurists of Ottoman Empire.
