Özet
Suç teşkil eden eylemin ve failinin yargılandığı bir süreç olan ceza muhakemesinin temel amacı maddi gerçeğe ulaşmaktır. Maddi gerçeğe de süreç içinde hukuka uygun yollarla elde edilmiş delillerle ulaşılmalıdır. Delilleri elde etme ve muhafaza altına almanın çok çeşitli yolları bulunmaktadır. Bu yolların en önemlilerinden biri de hiç kuşkusuz koruma tedbirleri arasında sayılan“gizli soruşturmacı görevlendirilmesi”tedbiridir. Özellikle terör, uyuşturucu ve uyarıcı madde ticareti gibi örgütlü işlenen suçlarla mücadelede bu tedbir oldukça büyük önem arz etmektedir. Bu tedbiri uygularken hukuktan ayrılarak delil elde edilmeye çalışılması, Anayasa ve uluslararası sözleşmelerle korunan, adil yargılanma hakkı ve özel hayatın gizliliği gibi pek çok temel hak ve özgürlüklerin ihlaline neden olunabilecektir. Bu nedenle, bahse konu tedbirin uygulanmasında bu hususların göz ardı edilmemesi gerekmektedir. Bu çalışmada; ceza muhakemesi sürecinde Türkiye'de delil elde etme yöntemlerinden olan gizli soruşturma usul ve tedbirlerinden belki de en hassas ve önem arz eden türü olan“gizli soruşturmacı görevlendirilmesi”tedbiri, anayasal hak ve özgürlüklere müdahale bağlamında ele alınmıştır.

The main purpose of criminal procedure, which is a process in which the criminal acts and their perpetrators are tried, is to reach the material truth. The material truth must be reached through evidence obtained by lawful means during the process. There are many ways to obtain and preserve evidence. One of the most important of these ways is undoubtedly the measure of“the appointment of undercover investigator”, which is considered among the protection measures. This measure is of great importance, especially in the fight against organized crime such as terrorism, illicit drug trafficking. Attempting to obtain evidence by deviating from the law while applying this measure may result in the violation of many fundamental rights and freedoms protected by the Constitution and international conventions, such as the right to a fair trial and privacy of private life. Therefore, these issues should not be ignored in the implementation of the measure in question. In this study; the measure of“the appointment of undercover investigator”, which is perhaps the most sensitive and important type of undercover investigation procedures and measures, being among the methods of obtaining evidence in Türkiye during the criminal procedure process, has been discussed in the context of interference with constitutional rights and freedoms.
