REPUBLIC OF TURKEY KOCAELİ UNIVERSITY INSTITUTE OF SOCIAL SCIENCE'S PUBLIC LAW SCIENCE BRANCH THE EXTRADITION AND THE CONCEPT OF POLITICAL OFFENCE Key words.-Extradition, Political Offence, Crimes Against Humanity, Terroristic Crimes, War Crimes Abstract: The escape of the guilty people in a country due to the rapid increase of transportation means in our age has caused the states to coorporate on extradition of those criminals for their own interest to prevent the criminals being unpunished. The concept of extradition has been displaying a unified jurisprudence vision with the determination matter of the criminal's action whether is political offense or not The main problem to be solved here is that which crimes are included in the concept of political offense and which crimes are excluded. The main approach in extradition is delivering the criminal person to the state where was the crime committed. The reverse is exception. Since in the beginning the political offense criminals perceived as the most dangerous criminals for the society, they had been the only extradited criminals when the concept was first started to practise. The ordinary crimes were included in extradition concept by the time. In the later stages, the right of refuge has caused refugees not to be extradited to the state in which the crime was committed and this rule is still valid today. The basis of this no-extradition concept is that the political offense criminal is likely being as the one who resists against political pressure, struggles for freedom and also there exists some doubts on judicious and neutral judgement of those type of criminals. But on the other hand a tendency for limiting the scope of the extradition from the point of crime type view is being observed. Due to this tendency, crimes against to the Presidents and their families, terroristic crimes, genocide-crimes against humanity, hijacking, counterfeiting and war crimes have been excluded from extradition. Thus the scope of political offense has been quite limited with these exclusions.
