Muslims are required to organise a board of Islamic jurists to judge in the absence of an Islamic Court (Qādı̄) in any country where Muslims are a minority, and the state does not recognise Islamic Law. In the absence of an Islamic Court (Qādı̄) in a country where Muslims are a minority, and the state does not recognise Islamic Law, Muslims must create a board of Islamic jurists to judge personal Sharia cases. When there is no Islamic government in power, the scholars' governance concept (wilāyat al-'ulamā') should be applied. Several Muslim jurists appear to have applied the notion of scholars' governance ̇(wilāyat al-'ulamā') to Muslim minorities living under the nonMuslim rule. The“ulamā”or Muslim scholars, play a crucial role in the unofficial application of Islamic law among Muslim minorities in non-Muslim countries. This body of scholars will take the role of a Qādı̄, and its decisions will be binding on all Muslims in countries where Muslims are a minority group. Firstly, the historical precedents for the application of the principle of scholar governance (wilāyat al-'ulamā') will be investigated in this dissertation. Secondly, the sharia councils will be investigated as a modern application of wilayat al-ulama in the United Kingdom. These councils were established to address Muslim matrimonial issues in the United Kingdom in accordance with Islamic family law. The councils are widely regarded as authoritative authorities in the field of Islamic law, with members representing all of the major schools of Islamic legal thought (madhab).
