Özet
6356 sayılı Sendikalar ve Toplu İş Sözleşmesi Kanunu 7 Kasım 2012 tarihinde, 28460 sayılı Resmi Gazete' de yayımlanarak yürürlüğe girmiştir. Çalışma yaşamı için önem arz eden toplu iş sözleşmelerinin geçerliliği Kanun'da yer alan şartlara bağlanmıştır. Toplu iş sözleşmesi yapabilme ehliyetine haiz olmak, toplu iş sözleşmesi akdedebilme yetkisine sahip olmak ve Çalışma ve Sosyal Güvenlik Bakanlığı'nca verilecek yetki belgesine haiz olmak bu kapsamda Kanun'da belirtilen şartlardandır. Tez, 6356 sayılı STİSK kapsamında, toplu iş sözleşmesi kavramı ve toplu iş sözleşmesi yapma yetkisi konusu ile sınırlılık göstermektedir. Çalışmada amaç, toplu iş sözleşmesi süreci ile özellikle toplu iş sözleşmesi yapma yetkisine yönelik uygulamada var olan aksaklıkların belirlenerek, öneriler sunmaktır. Tez, üç kısımdan oluşmaktadır. İlk bölümde, toplu iş sözleşmesi sürecine ilişkin genel bilgilendirmelere yer verilmiştir. Bu bölümde konunun rahatlıkla anlaşılması için toplu iş sözleşmesi kavramı tanımlanmıştır. Toplu iş sözleşmesinin hukuki niteliğine ve içeriğine ilişkin mevzuat kaynaklarından yararlanarak açıklamalar yapılmıştır. Toplu iş sözleşmesinin türlerinden bahsedilerek, toplu iş sözleşmesinde yetki konusuna zemin oluşturulmuştur. İkinci bölümde, toplu iş sözleşmesi yapılması için ehliyet ve yetkinin şartları ifade edilmiştir. Toplu iş sözleşmesi ehliyeti ve toplu iş sözleşmesi yetkisi arasındaki ilişkiye yer verilmiştir. Yetki belgesinin alınmasına kadar olan süreç Yargıtay kararlarıyla açıklanarak konu bu doğrultuda irdelenmiştir. Son bölümde ise, yetki itirazının işleyişine ve işleyişte ortaya çıkan sorunlara değinilmiştir. Olumlu ve olumsuz yetki tespitine itiraz konuları açıklanmıştır. Sonuç bölümünde sorunların çözümlerine yönelik öneriler sunularak literatüre katkıda bulunmak çalışmanın temel amacını oluşturmaktadır.

The Trade Unions and Collective Bargaining Law No. 6356 was published in the Official Newspaper No. 28460 on 7 November 2012 and entered into force. The validity of collective bargaining agreements, which are important for work life, is subject to the conditions in the Law. The conditions specified in the Law are to have the adequacy to make a collective bargaining agreement, to have the authority to conclude a collective bargaining agreement, and to have a certificate of authority to be given by the Ministry of Labor and Social Security. This thesis is limited to the concept of collective bargaining agreement and the authority to make a collective bargaining agreement within the scope of STISK No. 6356. The aim of the study is to determine the existing problems in the collective bargaining agreement process and especially in the application of the authority to make a collective bargaining agreement, and to present suggestions. The thesis consists of three parts. In the first part, general information about the collective bargaining agreement process is given. In this section, the concept of collective bargaining agreement is defined in order to understand the subject easily. Explanations were made regarding the legal natüre and content of the collective bargaining agreement. By mentioning the types of collective bargaining agreements, the basis for the issue of authority in the collective bargaining agreement has been established. laid for an easy understanding of the subject. In the second part, the conditions of competence and authority for making a collective bargaining agreement are stated. The relationship between collective bargaining competence and collective bargaing authority is given. The process until the receipt of the authorization certificate has been explained and the subject has been examined in this direction. expressed and the subject is examined in this regard. In the last part, the operation of the objection of authorization and the problems that arise in the operation are mentioned. Objections to positive and negative authorization determination are explained.
