Özet
112 ÖZET Bu çalışmanın birinci bölümünde; Türk Sosyal Güvenlik Sisteminde memurların emeklilik rejimi incelenmiştir. Bu bağlamda, emekliliğin konusu olan sosyal riskler izah edilmiştir. Memurların, emekliliğe hak kazanabilmesi için gerekli koşullara yer verilmiştir. Bu bölüm emeklilik uygulamasının tarihi gelişimi ile son bulmaktadır. İkinci bölümde; asıl çalışma konumuz olan, re 'sen emeklilik ve re 'sen emeklilik uygulaması incelenmektedir. Ayrıca re' sen emeklilere ve hak sahiplerine sağlanan haklar açıklanmaktadır. Üçüncü bölümde ise; yine çalışmamızın özünü oluşturan re'sen emeklilik işlemlerine karşı hukuki koruma ve uygulamada karşılaşılan sorunlara yer verilmektedir. Bu bağlamda; re'sen emekliye sevk işleminin hukuki niteliği ve bu işlemlerin dava konusu edilip edilemeyeceği konusu açıklığa kavuşturulmaktadır. Dava konusu edilebilirliği ortaya konulduktan sonra, görevli ve yetkili yargı mercii belirtilmektedir. Re'sen emekliye sevk işlemlerine karşı açılabilecek dava türlerinin incelendiği bu bölüm, re'sen emekliye sevk işlemlerinin iptali sonucu ortaya çıkan sorunlar ve bu sorunların çözümüne ilişkin görüşler ve uygulamaya da yer verilerek son bulmaktadır. Çalışmanın sonuç bölümünde ise, konunun genel bir değerlendirilmesi yapılmakta ve önerilere yer verilmektedir.

113 ABSTRACT In the first chapter of this study, the retirement regime of civil servants in Turkish Social Security System is examined. Under this context, social risks that are subject of retirement is explained. The necessary conditions for civil servants to get retirement are mentioned. This chapter is concluded with the retirement right of civil servant and the historical development of retirement implemantation. In the second chapter, the practise of forwarding the civil servant to the retirement which is the main theme of our study is examined. Furthermore, the rights granted to civil servant forwarded to the retirement are explained. In the third part legal protection against the procedures of forwarding the civil servants to the retirement and problems faced in the implemantation of this practice are mentioned. In this connection, the legal nature of procedure to forward the civil servant to the retirement and if this practice can be put into trial or not, are clarified. After having clarified the possibility to put this matter into trial, it is established which court is responsible and authorised to tackle with. This chapter which is examined the kinds of trials which can be put against the procedures of forwarding the civil servants to the retirement concludes with problems occurred in the result of cancellation of forwarding the civil servant to the retirement and opinions to solve these problems and finally its implemantation. In the last chapter of this study, an overall evaluation of this subject is made and some recommendations are given.
