Third party funding is no longer a new phenomenon, but rather a growing and developing practice. Even though it has been in practice for a substantial amount of time, the problems it caused are still waiting to be resolved. Supporters of third party funding rely on its access to justice aspect and its usage as a tool for risk management while opponents mainly fear that it will cause frivolous claims and disturb the process. On the other hand, third party funding practice increasingly continues in arbitration process. However, this practice is subject to many discussions and criticisms. The main purpose of this study is to demonstrate the current issues of third party funding and analyze the offered solutions. Issues mainly focus on the attorney's ethical duties, the disclosure of the relationship, conflict of interest and assessment of security for costs. Assessment of third party funding on the commercial arbitration basis is rather challenging. This difficulty predominantly rises from the confidential nature of the commercial arbitration. Since collecting related data from the commercial arbitration is quite difficult, to demonstrate the development of third party funding, relevant practice areas such as litigation and investment arbitration will be referred in this study. Another limitation when doing the analysis of third party funding is the fact that most of the sources and references are provided by funders. To pursue their businesses, they draw a picture of an imaginary wonderland where any obstacle can be abolished easily in the ultimate quest for access to justice. However, it does not seem like the real case, since the obstacles of uncertainty still block the way. The blurry area on third party funding needs to be cleared. The suitable solution to these problems seems to be regulatory actions regardless of the form. Considering the growing practice, the appropriate steps should be taken soon in order to create a more efficient working environment.
