Özet

Özel gereksinimli öğrenciler herhangi bir nedenle bireysel ve gelişim özellikleri ile eğitim yeterlilikleri açısından akranlarından anlamlı düzeyde farklılık gösteren bireyler olarak tanımlanmış olup bir ucunda çok ağır düzeyde zihinsel engelli bireyden diğer ucunda özel yetenekli bireye kadar uzanan çok geniş bir yelpazeyi kapsamaktadır. Türkiye'de özel gereksinimli bireylerin eğitimi hem genel eğitim mevzuatı içerisinde hem de 573 sayılı KHK ile birlikte ayrı bir mevzuatla ve bir de yönetmelikle (Özel Eğitim Hizmetleri Yönetmeliği) ile düzenlenmiştir. Eğitim ve öğretimin, devletin gözetimi ve denetimi altında yapıldığı özel okullarda da özel gereksinimli bireyin eğitimi bakımından hiçbir farklılık olmadığı halde okula kayıttan başlayarak tüm eğitimleri sırasında çok değişik biçimlerde ve çok sayıda hak ihlalleri yaşanmaktadır. Bu hak ihlalleri yargıya taşınmışsa da sonuç alınamamış ve Anayasa Mahkemesi kararı ve Avrupa İnsan Hakları Mahkemesi kararına konu olmuştur. Bu doktora çalışmasının kapsamı, özel okullarda okuyan özel gereksinimli öğrencilerle ilgili hak ihlallerinin özel hukuk bakımından sonuçlarıyla sınırlı tutulmuştur. Ancak niteliği itibarıyla uygun düştüğü ölçüde Özel Eğitim Rehabilitasyon Merkezleri gibi MEB Özel Öğretim Kurumları Genel Müdürlüğü'ne bağlı özel kurumlara da uygulanacağı konusunda tereddüttün olmaması için gerekli atıflarda da bulunulmuştur. Yürürlükte olan mevzuat ve Türk Borçlar Kanundaki Sorumluluk Hukukuna ilişkin genel düzenlemeler ile Hukuk Muhakemeleri Kanunundaki yargılama ve ispata ilişkin hükümler organize ve özel gereksinimli öğrenci ile velisine oranla çok daha güçlü konumda olan resmi ve özel okullar karşısında yeterli korumayı sağlamamaktadır. Oysa Türkiye başta Birleşmiş Milletler Çocuk Hakları Sözleşmesi olmak üzere birçok uluslararası sözleşmeye taraf olmakla bu yöndeki iç hukuk düzenlemelerini yapmayı kabul ve taahhüt etmiştir. Bu doktora çalışmasında özel gereksinimli öğrencilerin, özel okullarda yaşadığı eğitim hakkı ihlalleri ile buna uygulanabilecek sorumluluk hukuku kurallarının neler olduğu araştırılmış ve mevcut sorumluluk hukuku hükümlerinin yeterli korumayı sağlayamaması nedeniyle kusursuz sorumluluk içerisinde yer alan özen yükümlülüğü olarak Türk Borçlar Kanunu'nda ya da çıkarılacak Özel Eğitim Kanunu'nda bu konuda ayrı düzenleme yapılması gerektiği sonucuna varılmıştır.

Students with special needs are defined as individuals who differ significantly from their peers in terms of their personal and developmental characteristics and educational competencies for any reason and this spectrum of the students with special needs includes a variety of individuals from an individual with severely mentally disabled at one end and to a gifted individual. The education of the individuals with special needs in Turkey is regulated both within the general education legislation and by a separate legislation and regulation (Regulation on the Special Education Service) together with the Decree No. 573. In the private schools where education and training is carried out under the supervision and control of the state, although there is no difference in terms of the education of the individuals with special needs, violation of rights are experienced in many different ways during their education, starting from the enrollment to the school. Although these violations of rights were brought to the judiciary, no results were obtained and they became subject to the decisions of the Constitutional Court and the European Court of Human Rights. The scope of this doctoral thesis is limited to the consequences of the violations of rights in private schools with respect to the private law. However, necessary references have been made so that there is no hesitation that it can be applied to private institutions affiliated to the Ministry of National Education such as Special Education Rehabilitation Centers to the extent that it is appropriate. The legislation in force and the general regulations regarding the law of liability in the Turkish Code of Obligations and the provisions on trial and burden of proof in the Code of Civil Procedure do not provide sufficient protection for the students and their families against both public and private schools which are in a stronger position. Yet Turkey, as being party to many international conventions especially the United Nations Children's Rights Convention, has acknowledged and undertakes to make domestic law in this respect. In this doctoral thesis, the violations of the right to education faced by the students with special needs in private schools and the rules of liability law that can be applied to this are investigated, and since the current provisions in the liability law shall not provide sufficient protection, it has been concluded that a separate regulation should be made in the Turkish Code of Obligations or the Special Education Law that is to be enacted, as the duty of care included in the strict liability.
