Özet
Kamu gelirlerinin ve kamu harcamalarının miktar ve türünü belirleyerek yıllık olarak onaylama hakkına bütçe hakkı denilmektedir. Demokrasi ile paralel olarak gelişim gösteren bütçe hakkı, halkın temsilcisi olan yasama organları tarafından kullanılmaktadır. Ancak bütçe hakkı her yasama organı tarafından aynı şekilde ve etkinlikte kullanılamamaktadır. Çalışmada, bütçe hakkının yasama organı tarafından etkin kullanımı konusu ülkemizde değişen hükümet sistemi çerçevesinde ele alınmıştır. Çalışmada literatür taraması yapılarak çalışmalarda bütçe hakkının kullanımını etkileyen ortak faktörler belirlenmiştir. Konu ile ilgili olan çalışmalarda ve OECD, PEFA ve IBP gibi kuruluşların yaptığı anketlerde de vurgulanan faktörler; orta vadeli bütçe politikalarının yasama organınca görüşülüp onaylanması, bütçede değişiklik yapabilme yetkisi, bütçe müzakere süresi, komisyonların kapasitesi, geçici bütçe uygulaması, yürütme organına tanınan esneklikler, rol ve sorumluluk dağılımı, istenilen bilgilere ulaşabilme, bağımsız dış denetimin varlığı, kesin hesap kanunu, bütçenin kapsamlı olması, mali kuralların varlığı, yasama organının yapısı ve seçmenlerin tutumu olarak belirlenmiştir. İlgili faktörler temelinde; İngiltere, Amerika Birleşik Devletleri, Güney Kore, Fransa ve Şili ülke uygulamaları ile ülkemizde değişen hükümet sistemi uygulaması karşılaştırılmıştır. İlgili faktörler çerçevesinde karşılaştırılan ülkelerde, aynı hükümet sistemlerinin dahi farklı bütçe hakkı kullanım etkinliğine sahip olduğu saptanmıştır. Hükümet sistemlerinden ziyade ülkelere özgü siyasi ve kültürel etkiler, uygulanan yasal prosedürler bütçe hakkının kullanımını etkilediği söylenebilir.

Power of the purse; the right to approve annually by determining the amount and type of public revenues and public expenditures. The power of the purse, which develops in parallel with democracy, is used by the legislature, which is the representative of the people. However, the power of the purse cannot be used in the same way and effectively by every legislative body. In the study, the issue of the effective use of the budget right by the legislature is discussed within the framework of the changing government system in our country. In the study, the common factors affecting the use of the power of purse were determined by scanning the literature. Factors that are frequently emphasized in studies related to the subject and in surveys conducted by organizations OECD, PEFA and IBP; Legislative scrutiny of medium term budgetary frameworks, amendment powers, time available for legislative debate Legislatures, the role of committes, reversionary budgets, access to information, flexibility in budget execution, distribution of roles and responsibilities, independent external audit, comprehensiveness of budget, fiscal rules, the structure of the legislature and the attitude of the voters. On the basis of related factors; The practices of the United Kingdom, the United States of America, South Korea, France and Chile have been compared with the practice of the changing government system in our country. As a result, within the framework of relevant factors, different use of power of the purse in the same government systems has been determined. For this reason, it can be said that the political and cultural influences specific to the countries and the legal procedures applied instead of the government systems affect the exercise of the power of purse.
