Özet
Bu tezin amacı, bir kimsenin işlediği suç karşılığında hayatına son verilmesi anlamına gelen ölüm cezasının, leh ve aleyhindeki görüşleri ile uygulamasını gözler önüne sermektir. Birinci bölümde; ölüm cezasının tarihi gelişimine göz atılmış ve en eski çağlardan günümüze kadar ölüm cezasının nasıl bir seyir izlediği incelenmiştir. Ağustos 1995'te Suudi Arabistan'da gerçekleştirilen infazlar, İslam Hukukunun konuya bakışını merak ettirdiğinden, İslam Hukukuna geniş yer ayrılmıştır. Ayrıca çağdaş hukuklarda ölüm cezası ülke toplulukları baz alınarak incelenmiştir. İkinci bölümde, Türk Hukukunda ölüm cezası ile ilgili düzenlemelere göz atıldıktan sonra, tezin asıl konusunu oluşturan leh ve aleyhteki görüşler aktarılmıştır. Siyasi suçlarda ölüm cezası ve ölüm cezasının, mahkumlar ile yalanlan üzerindeki olumsuz etkileri başlıklı konularda önemleri dolayısıyla incelenmiştir. Çok tartışılan bir konu olan infaz problemi de irdelenmiştir. Ölüm cezası hakkındaki düşüncelerin durulmamışlığı ve belirsizliği ülkemizin hukuk hayatı açısından önemli bir problem olarak ortaya çıkmaktadır. Ölüm cezasına bakış netleşmemiş, bu konuda bir uzlaşmaya varılamamıştır. Mevcut durum, mağdurlar, suçlular, mağdur ve suçlu yakınları ile aydınlar tarafından eleştirilmektedir. Konu ile ilgili varılan sonuçlar ve getirilen öneriler tez bölümlerinde ve sonuç kısmında belirtilmiştir.

The aim of this dissertation is to lay bare the pros and cons and the application of the capital punishment which means putting an end to the life of a person who commits a crime. In the first part the historical development of the capital punishment has been reviewed together with the historical course of the capital punishment from the antique ages up to now. Since the executions carried out in Saudi Arabia in 1995 call to mind the approach of the Islamic Law to the subject ; ample space has been allocated to the subject. Furthermore, the capital punishment in contemporary judicial systems has also been reviewed on the basis of the communities. In the part; first the arrangements in connection with the capital punishment in the Turkish Law have been reviewed and then the pros and cons, being the main subject of the dissertation have been taken up. The capital punishment for the political crimes and the adverse affects of the capital convicts have also been reviewed due to their importance controversial subject has also been reviewed. The fluidity and vagueness of the opinions on the capital punishment constitute the most important problem of the Turkish jurisprudence. The views on the capital punishment are still not settled and no compromise has been reached on this subject. The present situation has been criticized by the victims, criminals and their relatives. The results that have been reached and proposals in connection with the subject have been indicated in the relevant parts and the result section of the dissertation.
