Özet
Danıştay Kararları Çerçevesinde Aylıktan Kesme Cezası konulu çalışmamızın ilk bölümünde devlet memurları disiplin hukukunun temel kavram, ilkelerine disiplin hukuku ve ceza hukuku ilişkisine, ceza hukuku ilkelerinin disiplin hukukunda uygulanmasına değinilmiştir. Danıştay Kararları ve Aylıktan Kesme Cezası başlıklı bölümde ise, Devlet Memurları Kanunun 125/C. maddesinde sıralanan disiplin suçları, Danıştay kararları çerçevesinde açıklandıktan sonra disiplin soruşturması, aylıktan kesme cezasının uygulanması, itiraz, yargı yolu, affın aylıktan kesme cezasına etkisi, disiplin hükümleri, doktrindeki görüşler ve ağırlıklı Danıştay kararları çerçevesinde incelenmiştir. Çalışmamızda, 657 sayılı Devlet Memurları Kanunu'nda düzenlenen aylıktan kesme cezası özelinde, disiplin suçunun öğrenilmesi ile başlayan süreçte, uygulamada, karşılaşılan sorunlara Danıştay'ın nasıl yaklaştığı, bakış açısı, farklı örnek kararlar ışığında değerlendirilmeye çalışılmıştır.

In the first part of the study, on the penalty of cutting from the monthly within the framework of the Council of State Decisions, the basic concepts, principles, disciplinary law and the relationship between the disciplinary law and criminal law, the application of the principles of criminal law in disciplinary law are mentioned. In the section, titled Decisions of the Council of State and Punishment from Monthly, the disciplinary offenses, listed in the Civil Servants Law 125 / C, were examined within the framework of the disciplinary investigation after the disclosure, within the framework of the decisions of the Council of State, the application of the monthly penalty, the appeal, the remedy, the effect of the amnesty on the monthly penalty, disciplinary provisions, opinions in the doctrine and weighted decisions of the Council of State. In this study, it is tried to evaluate how the Council of State approaches the problems encountered in practice related to the disciplinary process, what is the point of view, in the light of different example decisions of the Council of State.
