Özet
Osmanlı mahkemelerinde verilen kararların kayıt altına alındığı defterlere şer'iyye sicilleri denir. Bu siciller kaydedildikleri döneme dair siyasî, sosyal, kültürel vb. alanda birçok konuya ışık tutabilecek belgelerdir. Özellikle tarih araştırmalarında birincil kaynak olan şer'iyye sicilleri, ihtiva ettikleri bilgiler nedeni ile önemli bir yere sahiptir. Çalışmamızın konusu, İstanbul Bâb Mahkemeleri 303 No'lu Şer'iyye Sicili'dir. Bu sicil defteri, Hicri 1203-1205/ Milâdi 1789-1791 tarih aralıklarında mahkemeye intikal etmiş davalardan oluşmaktadır. Defter A3 boyutunda 69 sayfa ve 467 hükümden oluşmaktadır. İçeriğinde boşanma, miras, vasî tayini, vakıf, mülk ve alacak davaları gibi dava konuları bulunmaktadır. Tez, giriş ve dört bölümden oluşmaktadır. Giriş bölümünde genel bir bilgilendirilme yapılmıştır. Birinci bölümde Osmanlı hukuk yapısı, mahkemeleri ve personellerine dair bilgiler mevcuttur. Tezin ikinci bölümünde konumuz olan şer'iyye sicilleri ve defterimizde bulunan belge türleri incelenmiştir. Üçüncü bölümde“İstanbul Bâb Mahkemesi 303 no'lu Şer'iyye Sicil”defterinin değerlendirilmesi ve dördüncü bölümde ise transkripsiyonlu metni bulunmaktadır.

The notebooks Where the decisions of the Ottoman courts are recorded are called Şer'iyye Registers (İslamic court records). These records are documents that can shed light on many issues in the fields such as political, social and cultural. Especially in history research, the Şeriyye Registers, which are the primary sources, have an important place due to the information they contain. The subject of our study is Şer'iyye records, No 303 of the Istanbul Bâb Courts. This register is composed of cases that have been brought to court in the period of 1789-1791 / Hijri 1203-1205. The notebook consists of 69 pages and 467 sentences in A3 size. There are cases such as divorce, inheritance, guardianship, foundation, property and claims cases. The thesis consists of four sections. General information was given in the introduction section. In the first part, information about Ottoman law structure, courts and staff is available. In the second part of the thesis, the subject of the Şer'iyye records and the document types found in the book are examined. In the third part the evaluation and fourth part the transcribed text of Istanbul Bâb Court No: 303, Şer'iyye Registry Book.
