Özet
Bu çalışmada, genel kamu hukukunun önemli bir araştırma konusu olan devletin kökenleri ve gelişimi ile ilgili teoriler, eleştirel bir çerçevede incelenmiştir. Genel kamu hukukunun konusu olarak devleti birçok yönlerden incelemek mümkündür. Bu bakımdan devletin; tarihi, iktisadi, siyasi veya hukuki çehreleriyle incelenmesi mümkündür. Fakat, genel kamu hukuku bağlamında devlet, herhangi somut bir devlet değildir. Bir başka ifadeyle, genel kamu hukuku için devlet, bütün devletler için ortak ve geçerli ilkeleri taşıyan devlettir. Dolayısıyla, devletin kökenleri ile ilgili teoriler, işte bu ortak ve geçerli ilkeleri oluşturabilmek için ele alınıp incelenmektedir. Bu bağlamda, toplam üç bölümden oluşmakta olan tezin ilk bölümünde, konuyla ilgili temel kavramlar ve yaklaşımlar ele alınmıştır. İkinci bölümde, devletin kökenleri ile ilgili teorilerin tarihi ve sınıflandırılmasına yer verilmiştir. Üçüncü bölümde ise, devletin kökenleri ile ilgili teoriler yaptığımız sınıflandırmalar çerçevesinde incelenmiştir. Devletin kökenleri ile ilgili teorilerin değerlendirilebilmesi için, bazı öncü teorik ve kavramsal tartışmaların yapılması gereklidir. Bunun için, başta devlet kavramı olmak üzere, teori ve köken kavramlarının mevcut kullanımı eleştirilmiştir. Devletin kökenleri ile ilgili teoriler, genel kamu hukukunun yanı sıra siyasal antropoloji, siyaset bilimi, tarih, sosyoloji ve arkeoloji gibi disiplinlerin de inceleme alanına girmektedir. Dolayısıyla bu disiplinlerin sunduğu kavramsal çerçevenin birlikte göz önünde bulundurulması gerekir.

In this study, theories about the origins and development of the state, which is an important research subject of general public law, have been examined in a critical framework. As a matter of general public law, it is possible to examine the state in many ways. In this respect, it is possible to examine the historical, economic, political and legal aspects of the state. However, in the context of general public law, the state is not a concrete state. In other words, the state for general public law is the state that has common and valid principles for all states. Hence, theories about the origins of the state are examined and studied in order to create these common and valid principles. In this context, in the first part of the thesis, which consists of three parts, basic concepts and approaches related to the subject are discussed. In the second chapter, the history and classification of the theories about the origins of the state are included. In the third chapter, the theories about the origins of the state are examined within the framework of the classifications. In order to evaluate the theories about the origins of the state, some leading theoretical and conceptual discussions should be made. In order to do this, the current use of the concepts of theory and origin, first of all the state concept, has been criticized. The theories related to the origins of the state are included in the field of disciplines such as political anthropology, political science, history, sociology and archeology as well as general public law. Therefore, the conceptual framework presented by these disciplines should be considered together.
