Özet
Bu çalışmanın amacı, din ve vicdan özgürlüğün tarihsel ve felsefi temellerini ortaya koymaktır. İnsan haklarının önemli bir parçasını teşkil eden din ve vicdan özgürlüğünün çok uzun bir tarihsel geçmişi vardır. Konuya dair ilk emareleri, Antik Yunan döneminde bulmamız mümkündür ve felsefi olarak da Sokrates, Platon ve Aristoteles bilinen tarih içerisinde konuya ilişkin ilk görüş bildiren felsefecilerdendir. Dahası, Roma İmparatorluğu dönemi, ortaçağ ve yeniçağ da bu özgürlüğün gelişimine dair önemli dönemlerdir. Diğer taraftan hukuki anlamda korunması süreci görece yeni olan din ve vicdan özgürlüğünün anayasal boyut kazanması ise 17. yüzyıl sonlarına tekabül etmektedir. Din ve vicdan özgürlüğünün felsefi boyutuyla tarihsel süreç içerisinde geçirdiği merhaleleri iyi anlamak ve analiz etmek, günümüz dünyasında konuyla ilgili karşılaşılan problemlere ve devletin ya da diğer otoritelerin dini ve vicdani özgürlüğe yönelik her türlü müdahalesinin muhtemel sonuçlarına dair bir ipucu teşkil edebilecektir. Tezde literatür taramasına dayalı tarama- değerlendirme yöntemi kullanılmış olup, konuya dair akademik makaleler, kitaplar, tezler ve diğer bilimsel eserler incelenmiş ve konu anlam bütünlüğü içerisinde ele alınmıştır.

The aim of this master thesis to clarify the historical and philosophical origins of freedom of religion and conscience. The freedom of religion and conscience plays an integral role in human rights and has a very long historical background. We can find the first vestiges of circumstantial evidence for freedom of religion in the period of the Ancient Greeks by philosophical origins like Socrates, Plato and Aristotle. Moreover, the period of Roman Empire, the Medieval Ages and Modern Age are also important sources for the subject. On the other hand, in the realm of law this subject is relatively new, but the freedom of religion and conscience became a constitutional subject at the end of the 17th century. Understanding and analyzing the historical background and philosophical developments of the freedom of religion and conscience, gives us insight into the results of the different kinds of intervention by the state and other authorities imposed on religious and conscience freedoms. This is a review of the freedom of religion and conscience; therefore the main resources are scientific articles, books, master and PhD thesis and other scientific research in this area of literature. I studied the problematic details at hand and tried to gather scientific views on this subject.
