Özet
7101 sayılı kanunla birlikte geçmişte uygulanan iflasın ertelenmesi kurumu tamamen yürürlülükten kaldırılmış olup bunun yerine geçmesi adına mevzuatımızda var olan konkordato, yapısal değişikliklerle hükümlerinin kapsamı geliştirilmiştir. İflas ve ticaret hukukuna ilişkin bazı rehabilite çalışmaları, kendini konkordato sürecinin yeniden etkin hale getirilmesi şeklinde tasarlanmış olup konkordato uygulaması, mali yapısı bozulan borçlular bakımından ön plana çıkmış ve etkin bir kurum haline gelmiştir. Yapısal değişiklikler nedeniyle, çalışmamız kapsamında uygulamada konkordato sürecinde yaşanması muhtemel belirsizliklerin giderilmesi için açıklayıcı bilgilere yer verilmiş ve çözüm önerileri sunulmuştur. Bu çalışma iflasın ertelenmesinin yerine geçmesi adına konkordato kurumunu incelemektir. Çalışma kapsamında iflasın ertelenmesi süreci ayrıntılı olarak incelenerek konkordato kurumunun mukayeseli analizi yapılmıştır. Çalışmanın konusu oldukça yeni bir konu olması nedeniyle bu çalışma, ilgili alana katkı sağlamayı hedeflemektedir. Çalışmada 2004 sayılı kanunda geçen iflasın ertelenmesi ile ilgili maddeler ve 7101 sayılı kanun ile getirilen düzenlemeler sonucunda konkordato ile ilgili maddeler arasındaki benzer ve farklı yönler ortaya konulmuş olup konkordato kurumunun uygulanabilirliği hakkında öneriler yer almaktadır.

With the Law No. 7101, postponement of bankruptcy has been completely abolished and instead, Scope of the provisions of bankrupt's certificate, with some structural changes, has been improved.Some rehabilitation studies that are related to bankruptcy and commercial law, designed itself just like re-activating the process of bankrupt's certificate. In terms of debtors, the execution of bankrupt's certificate has come into prominence and has become an active institution.In this study, some expository information and proposals are presented in order to eliminate possible uncertainties during the process of bankrupt's certificate that are results of structural changes. The aim of this study is to examine the bankrupt's certificate which will take place of postponement of bankruptcy. In this study, the postponement of Bankruptcy process has been analyzed in detail and compared to the bankrupt's certificate. This study aims to contribute to the field as this is a new topic in the area. In this study, the similarities and the differences between the articles related with postponement of the bankruptcy in the Law no 2004 and the articles related with the bankrupt's certificate in the Law no 7101 are presented. There are also some proposal about the applicability of the bankrupt's certificate.
