Özet
Bu çalışmada, finansal kiralamanın gelişim süreci ve çeşitleri araştırılmış, konuya ilişkin ülkemiz uygulamaları incelenmiş, mevzuatımızın nasıl oluştuğu, uygulamaya nasıl yansıdığı araştırılmış, sektörün sağlıklı bir biçimde işleyişini engelleyen sorunlar tespit edilerek bunlara çözümler üretilmiştir. Bu çerçevede, uluslararası alanda yeni bir finansman yöntemi olmasına rağmen finansal kiralamanın hızla geliştiği, ürün çeşidinin zaman içinde artığı belirlenmiştir. Ülkemizde, konuya ilişkin düzenlemelerin sektörün ihtiyaçlarını karşılamada yetersiz kaldığı ve yenilenmesi gerektiği görülmüştür. Sektörün, kendi bütünlüğü içinde istikrarlı bir yapıya sahip olduğu, sisteme girişlerin devam ettiği, ancak nitelik ve nicelik yönünden hala tatmin edici düzeyde görünüme sahip olmakla birlikte, finansal kiralama sektöründe banka ortaklı şirketlerin ağırlığı, oligopol yapıya doğru eğilim göstermiştir. Finansal kiralama işlemleri üretim malları üzerine odaklanmış ve yatırımların finansmanında uzmanlaşmaya gidilmiştir. Ek olarak, finansal kiralama sektörünün gelişimini engelleyen sorunların iktisadi ve hukuki konularda yoğunlaştığı görülmüştür.

At this study, the development process of financial leasing and its types are searched; the formation of the legal regulations related to the financial leasing in our country and their reflections on the applications are tried to be determined;the problems preventing the smooth development of the sector are determined and the soltions to these are tried to be produced. In this framework, though it is a new financial technique in international area, it is found out that financial leasing is progressing rapidly, its product variety is increasing. It is seen that the regulations in our country are inadequate in meeting needs of the sector and should be amended. Beside the stable structure in its complete form and the entrances going in the sector, it is not at the sufficient level in quantitative and qualitative manner. Although it seems like there is a competitive structure in the sector; the serious weight of the bank affiliated financial leasing companies, makes the sector oligopolistic. Whereas, it should be the Long-Term fund, due to the economic fluctuations, leasing has become a Short-Term financial equipment. In financial leasing operations, there is an intensification in the production goods and specialization in the finance of investment. Besides, it is concluded that the problems preventing the progress of the sector focused on the economic and legal areas.
