Özet
Ceza hukukunun evrensel ilkelerinden biri olan nemo tenetur ilkesi özü itibariyle, bir kimsenin kendisinden zorla, beyan ve delil elde edilmesini engellemeyi amaçlamaktadır. Nemo tenetur ilkesi bu kapsamda; insan onurunun ve kişi dokunulmazlığının temel bir güvencesi olmasının yanı sıra savunma hakkının ayrılmaz bir parçası olarak adil yargılanma ilkesinin de teminatını oluşturmaktadır. Nemo tenetur ilkesi kapsamında, belge ve kayıt ibraz yükümlülüğü öngörülüp öngörülmeyeceği ve yükümlülüğe aykırılığın yaptırımının ne olması gerektiği tartışmalı bir konudur. Zira kanun koyucu tarafından; kamu hizmetlerinin etkinliğinin sağlanması, vergilerin toplanması ve kayıt dışı ekonomiyle mücadele, ekonomik hayatın güvenirliliğinin ve şeffaflığının temini, piyasanın düzenlenmesi ve kontrolü, suç gelirlerinin aklanmasının önlenmesi gibi çeşitli mülahazalarla nihai olarak kamu yararı amaçlanarak birçok kanunda, belge ve kayıt ibraz yükümlülüğü öngörülmüştür. Bu kapsamda Bankacılık Kanunu, Sermaye Piyasası Kanunu, Vergi Usul Kanunu ve Finansal Kiralama, Faktoring, Finansman ve Tasarruf Finansman Şirketleri Kanununda, belge ve kayıt ibraz yükümlülüğüne aykırılık suç olarak düzenlenmiş ve hapis cezası yaptırımı öngörülmüş iken Türk Ticaret Kanunu, Gümrük Kanunu ve Sosyal Sigortalar ve Genel Sağlık Sigortası Kanununda ise belge ve kayıt ibraz yükümlülüğüne aykırılık kabahat olarak düzenlenmiş ve yaptırım olarak idari para cezası öngörülmüştür. Bu çerçevede çalışmamız kapsamında Türk ceza hukukunda nemo tenetur ilkesinin kapsamının ve sınırlarının çizilmesi ile nemo tenetur ilkesi karşısında belge ve ibraz yükümlülüğünün nasıl değerlendirilmesi gerektiği hususu, Avrupa İnsan Hakları Mahkemesi kararları, Anayasa Mahkemesi kararları ve doktrindeki görüşler ışığında detaylı bir biçimde ele alınarak irdelenmiştir.

The nemo tenetur principle, one of the universal principles of criminal law, essentially aims to prevent the extraction of statements and evidence from an individual through coercion. Within this scope, the nemo tenetur principle, in addition to constituting a fundamental safeguard for human dignity and personal inviolability, also serves as a guarantee of the right to a fair trial, as it forms an inseparable component of the right to defence. In the context of the nemo tenetur principle, whether an obligation to produce documents and records may be imposed, and what the sanction for non-compliance with such an obligation should be, remains a contentious issue. This is because, for various considerations—such as ensuring the efficiency of public services, collecting taxes, combating the informal economy, ensuring the reliability and transparency of economic life, regulating and supervising the market, and preventing the laundering of criminal proceeds—the legislator, ultimately pursuing the public interest, has introduced an obligation to produce documents and records in numerous statutes. In this regard, while non-compliance with the obligation to produce documents and records is classified as a criminal offence subject to imprisonment under the Banking Law, the Capital Markets Law, the Tax Procedure Law, and the Law on Financial Leasing, Factoring, Financing and Savings Finance Companies, it is classified as an administrative misdemeanour subject to an administrative fine under the Turkish Commercial Code, the Customs Law, and the Social Insurance and General Health Insurance Law. Within this framework, the present study examines in detail, in light of the case law of the European Court of Human Rights, the decisions of the Constitutional Court, and scholarly opinions, the scope and limits of the nemo tenetur principle in Turkish criminal law, as well as how the obligation to produce documents should be assessed in relation to the nemo tenetur principle.
