Özet
Son dönemlerde, bireylerin özgürlük alanları ile ters orantılı şekilde gelişen ve ilerleyen teknoloji sayesinde, birey ve bireyin sahip olduğu temel hak ve özgürlüklere dair tehdit ve tehlikeler de artmaya devam etmektedir. Bireye yönelmiş olan ve tezimizin konusunu oluşturan bu tehlikelerden birisi olarak kişisel verilerin korunması ve bu bağlamda kişisel verilerin ihlali şüphesiz ki teknoloji, küreselleşme, sanal âlem gibi olgularla bağlantılıdır. Zira kişisel verilerin, özellikle bilişim sistemleri aracılığı ile sınır tanımaksızın hareket edebilmesi, bu verilerin sanal dünyada kayıt altına alınarak elden ele dolaşabilmesi, birey açısından çok büyük riskleri de beraberinde getirmiştir. Bu tehditlere ve tehlikelere karşı bireyin korunması için yasal zeminlerin sağlam şekilde oluşturulması bireyi ve de kişi temel hak ve özgürlüklerinin korunması için oldukça önemlidir. Avrupa Birliği'ne katılım ve uyum sürecinde Türkiye, sahip olması gereken yasal düzenlemelerden birisi olarak Kişisel Verilerin Korunması Kanunu'nu daha çok yeni kabul etmiş ve bu alanda önemli bir eksikliği gidermiş görünmektedir. Anayasada yer alan hükümlerin yasal düzenleme ile genişletilerek bu alana ait kavram ve ilkelerin belirlenmesi, karşılaşılacak olan ihtilafların giderilmesinde çözüm odaklı olunmasında önemli yer tutacaktır. Bu bağlamda çalışmamızın birinci bölümünde, kişisel verilerin korunması alanında kullanılmakta olan temel kavramlar ve kişisel verilerin işlenmesinde geçerli olan ilkeler üzerinde durulmuştur. İkinci bölümde ise kişisel verilerin saklanması, güvenliği ve korunması hususları açıklanmaya çalışılmıştır. Bu amaçla kişisel verilerin korunması alanının gelişimi, uluslararası ve ulusal düzeyde bu alanda yaşanan gelişmeler ve yapılan düzenlemeler, hukuki boyutta ele alınmıştır. Son olarak üçüncü bölümde de, kişisel verileri, devlet ya da üçüncü kişilerin elinde bulunmak suretiyle sürekli olarak bir tehlike, tehdit ve hak ihlali gibi durumlarla karşı karşıya kalan veri sahibinin sahip olduğu ve olması gereken haklar incelenmeye çalışılmıştır.

Recently, by means of technology which improves and advances inversely proportional to individuals' area of freedom, threats and dangers about individuals and fundamental rights and freedoms of individuals continue to rise. Personal data protection and, in this regard, violation of personal data as one of these threats that is related to individual and that constitutes the subject of this thesis are undoubtedly connected with some facts such as technology, globalization, and cyber world. For this reason, movement of personal data particularly through information systems without boundaries, recording of these data in the cyber world and changing hands many times leads to great risks for individuals. It is very important to form a solid legal basis to protect individuals against these threats and hazards with regards to protecting individuals and fundamental rights and freedoms. In the process of participation and integration to the European Union, Turkey has very recently enacted the Law of Personal Data Protection (Privacy Act) as one of the legal regulations that is should have, and seems to fill an important gap in this field. Determination of the concepts and principles belonging to this field by enlarging through a legal regulation of constitutional provisions will take an important place to be solution oriented in eliminating the conflicts to be faced. In this regard, in the first part of the study, basic concepts used in the field of personal data protection and the principles that are valid in processing of personal data are discoursed. In the second part, it is tried to be explained the issues of storage, security and protection of personal data. For this purpose, the improvement of personal data protection, the developments and arrangements in this field at national and international scale are discussed at legal dimension. Lastly, in the third part, the rights that a data owner, who is continuously faced with cases such as danger, threat and violation of rights by means of that the owner's data is in the hands of third parties, has and should have are tried to be analyzed.
