273 ÎNGÎLIZCE ÖZET (SUMMARY IN ENGLISH) This study (BANKRUPTCY IN PRIVATE INTERNATIONAL LAW) examines the international jurisdiction. choice of law» recognition and enforcement problems in bankruptcies having international aspects. In the course of the study it has been concluded that, none of the principles (universality or territoriality) on its own is satisfactory to provide solution for every issue of international bankruptcy. Nevertheless, with a view to ensuring equality among the entire creditors of the debtor. the study. in principle, supports the principle of universality. Briefly the following results have been achieved : States. as regards international jurisdiction of local courts, to avoid conflicts of jurisdiction. should adapt connecting factors that are not inclined to multiplicity (direct international jurisdiction). Substantive requirements for opening a bankruptcy (grounds for opening a bankruptcy, persons amenable to bankruptcy) should be subject to the law of debtor's center of administration (traders-legal persons). law of place of business (or commercial domicile. traders-natural persons) and to lex domicilii (non- traders-natural persons). Legal consequences of opening of a bankruptcy: cessation of debtor's powers to deal with his property and related matters should be subject to lex situs; creditors' rights as against the estate, appointment and powers of the liquidator and formation of the estate should be governed by lex fori; collection. administration, management and disposition of individual assets should be subject to lex situs; effect of bankruptcy on current contracts should be ascertained in accordance with the law governing the contract; setting aside of suspect period transactions, suspension and stay of actions, prohibition of individual proceedings brought by creditors and closure of bankruptcy should be subject to lex fori; grounds for annulment of bankruptcy decrees (ex. composition) should be274 subject to the law governing the persons amenable to bankruptcy. Foreign bankruptcy decrees rendered by the courts of debtor's center of administration (traders- legal persons), place of business (or commercial domicile, traders-natural persons) and domicile (non-traders-natural persons) or status and powers of the liquidator should be given extra-territorial effect without being subject to the requirement of reciprocity. Public policy proviso as against foreign bankruptcy decrees should not be invoked unless it had been rendered by the courts of a country that does not respect the principle of creditors' equality or adapts the principle of territoriality.
