Özet
Gelişen teknoloji ve bu teknolojinin günlük hayatta kullanımı sonucu hukukî uyuşmazlıklara konu olan sosyal ilişkiler karmaşıklaşmış ve bu ilişkilerin bir kısmının niteliğinin anlaşılabilmesi uzmanlık gerektirir hale gelmiştir. Bu gibi hallerde, davayı karara bağlamakla yükümlü olan hâkim, kendisinde bulunmayan özel veya teknik bilgiye sahip kişilere başvurma ihtiyacı duymuştur. Söz konusu özel ve teknik bilgiye sahip kişilerin ne şekilde tayin edile¬ceği konusunda Kıta Avrupası hukuk sisteminde esas olarak geçerli olan bilirkişilerin mahkemece atanması ile Anglo-Sakson hukuk sisteminde esas olarak geçerli olan uzmanın taraflarca atanmasıdır. Anglo-Sakson hukuk sistemlerinde uzmanın mahkemece atanması yönünde bir eğilim olurken, Kıta Avrupası hukuk sistemlerinin geçerli olduğu ülkeler de ise bilirkişi yanında tarafların uzmana başvurabilmesi hakkı tanınmıştır. Türk hukukunda ise teamülde uygulanagelen uzman görüşü, 2011 yılında yürürlüğe giren Hukuk Muhakemeleri Kanunu'nda“İspat ve Deliller”bölümünde ayrı bir madde olarak m.293'te düzenlenmiştir.

Social relations that become the subject of the legal disputes have got complicated as a result of the imroving technology and usage of it in daily life and expertise have became necessary in order the nature of some of these relations to be understood. In such cases the judge who is obliged to conclude the case has needed to refer to the people having special or technical knowledge which the judge has not have. There are mainly two way to appoint those people who has special or technical knowledge. In Continental European legal system, people who has special or technical knowledge are appointed by courts. On the other hand, In Anglo-Saxon legal system, people who has special or technical knowledge are appointed by parties. However, Anglo-Saxon legal system is tending to appointment of experts by courts and Continental European legal system is allowing to appointment of experts by parties. Êxpert witness appointed by parties is not a new institution for Turkish legal system but as a new process, expert witness appointed by parties is legalised in Article 293, in“Proof and Evidence”section in Code of Turkish Civil Procedure that was enacted in 2011.
