Özet
“Metus Kavramı ve Kurumlarının İncelenmesi”isimli bu Doktora tez çalışması, Giriş ve Sonuç dışında beş bölümden oluşmuştur. Bu çalışma Roma Hukukunda metus (Tehdit / Korkutma) kavramı ve bununla ilgili düzenlemeleri günümüze olan yansımasıyla birlikte incelemektedir. Birinci Bölümde, metus kavramının incelenmesi, konu ile ilgili terminolojinin oluşturulması ve praetorların hukuk yaratım faaliyetleri incelenmektedir. Bu başlık altında metus örneğinde olduğu gibi, ius civile'nin çözümsüz kaldığı durumlarda praetorların hukuk yaratıcılığı sayesinde Roma Hukukunun adalet ve hakkaniyeti nasıl gerçekleştirdiğine dikkat çekilmektedir. İkinci Bölümde, metus'un belgelere yansıması, bir diğer deyişle, Institutiones ve Digesta'da metus ve metus ile ilgili kavramların yer aldığı Latince metinlerin incelenmesi söz konusudur. Üçüncü Bölümde, bir sözleşmenin metus etkisi altında kurulduğunu kabul edebilmek için varolması gereken şartlar (unsurlar) incelenmektedir. Dördüncü Bölümde, metus halinde tanınan koruyucu vasıtalar incelenmektedir. Koruma vasıtaları olarak; actio, exceptio ve in integrum restitutio'lar ele alınmaktadır. Nihayet, beşinci Bölümde, mukayeseli hukukta metus'un ele alınışı incelenerek Roma Hukukunun etkileri gösterilmeye çalışılmıştır. Bu kapsamda mecelle'den müşterek hukuka, modern avrupa hukuklarından, belli başlı uzak doğu ülkelerindeki hukuk sistemlerine kadar metus konusunun düzenlenişi vasıtasıyla Roma hukukunun etkileri gösterilmeye çalışılmıştır.

This doctorate thesis,“Reviewing the Concept of Metus and It's Institutions”, consists of five sections excluding Introduction and Conclusion. This study examines the concept of metus (threat / duress) in Roman law and related regulations, by the reflections of the present day. In the first part, the following are being mentioned: examination of the concept of metus, forming the terminology related to the subject and preator's activities of creating the law are examined. Under this title, the attention is drawn to how Roman Law realises justice and equity thanks to the praetors' creation of law, when ius civile remains unresolved, as in the case of metus. In the second part, the reflection of metus on documents, in other words, reviewing the Latin texts of Institutions and Digest in which metus and the terms related to metus take parts. In the third part, the existing conditions (elements) in order to recognize that a contract under the effect of metus was to be established, are examined. In the fourth part, granted protective means on the case of metus, are examined. As the means of protection; action, exception and restitution in integrum are being discussed. Finally, in the fifth part, it is attempted to show the effects of Roman Law by examining the handling of metus in comparative law. In this context, from the Medjelle to the common law and from the law of modern Europe, to the Far East countries' law systems; it is attempted to show the effects of Roman law through the regulation of metus.
