Özet
Sigorta hukukunda halefiyet kurumunun amaçlarının gerçekleşebilmesi için sigortalının sigortacının halefiyetle ilgili haklarını ihlal etmeme ve koruma yükümlükleri bulunmaktadır. Bu çalışmada, sigortalının bu yükümlülüğünün kapsamı ve yükümlülüğe aykırılık durumunda sigortacının kullanabileceği hakların incelenmesi amaçlanmıştır. Bu kapsamda öncelikle bu yükümlülüğün kapsamına hangi hususların dahil olduğu ve uygulamada görülen ihlal örnekleri, daha sonra ise bu yükümlülüğün ihlali durumunda sigortacının kullanabileceği haklar incelenmiştir.

In the area of the insurance law, in order to properly perform the functions of subrogation as a concept, the insurant is under duty to protect and not to infringe insurer?s right to subrogate. In this study, the scope of those obligations and the rights of the insurer in case of any infringements are examined. Thus, firstly the situations which fall under that scope and some cases exemplifying the typical kind of violation of those obligations are studied. Then, the rights of the insurer in case of violations of those obligations are examined.
