Özet
Bu çalışma Kocaeli Üniversitesi Sosyal Bilimler Enstitüsünde yüksek lisans tezi olarak hazırlanmıştır. Tezde tartışılan konu ?çeke duyulan güveni arttırmaya yönelik işlemlerdir?. Tezin birinci bölümünde çeki güvenilir kılan temel özellikler ve buna ilişkin yasal düzenlemeler incelenmiştir. İkinci bölümde muhatabın çeke duyulan güveni arttırmaya yönelik işlemleri başlığı altında ?bloke çek? ve ?garantili çek? kavramı ele alınmıştır. Bloke çek başlığı altında çekin teyidinin hukuki mahiyeti, çekin teyidinin kabulden farkı, teyit şekli ve yapılış usulü, teyidin geçerlilik süresi ve sonuçları üzerinde durulmuştur. Ayrıca muhatabın güven attırıcı diğer yöntemi olarak da garantili çek uygulaması incelenmiştir. Bu uygulamanın gelişim süreci, ülkemizdeki uygulama çeşidi, muhatap bankanın ödeme garantisinin doğuşu ile ilgili görüşler, bu tür çeklerin geçerliliği, kabul yasağı bakımından değerlendirilmesi; teyit edilmiş çeklerle arasındaki temel farklar, muhatabın defi ileri sürebileceği durumlar, şikayet hakkı ve garantili çek anlaşmasının sona ermesi konuları incelenmiştir.Üçüncü bölümde keşideci ve lehtarın güven arttırıcı işlemleri olarak çizgili çek ve mahsup çekleri ele alınmıştır. Bu bölümde öncelikle çizgili çek konu başlığı altında; çeki çizmeye yetkili kişiler, çizgili çekin unsurları, genel çizilmiş çizgili çek ve özel çizilmiş çizgili çek çeşitleri incelenmiştir. Bu bölümde ikinci olarak mahsup çekleri incelenmiştir. Mahsup çeklerini düzenlemeye yetkili kişiler, mahsup çekinin düzenlenme şekli, bu kaydın hukuki değerlendirmesi, muhatabın meydana gelecek zararlardan sorumluluğu ve mahsup çeklerinde nakden ödeme talep edilecek istisnai haller incelenmiştir.Sonuç olarak çeke duyulan güveni arttırmaya yönelik işlemleri ticaret erbabına çeşitli yöntemlerle tanıtarak, bu tür çeklerin kullanımının arttırılmasının ticaret hayatının daha güvenli ve bilinçli gelişmesine önemli katkıda bulunacağı kanaatindeyiz.

This paper is prepared as a master thesis in Kocaeli University Social Sciences Institute. The subject that is discussed in the thesis is ?the actions to strengthen the reliability of the cheque?. In the first section of the thesis, the basic features which make the cheque reliable and the related legal regulations are discussed. In the second section, ?blocked cheque? and ?guaranteed cheque? concepts are mentioned under the heading of ?the actions in order to increase the reliability of the cheque?. Under the blocked cheque heading, the legal issues related to the confirmation of the cheque, the difference between the confirmation of the cheque and the acceptance of the cheque, types of confirmation and their applications, and the results of the confirmation are discussed. In addition, as an other method of increasing the reliance, the guaranteed cheque application, the evolution of this application, the types of this application in our country, the ideas related to the emergence of the payment guarantee of the respondent bank, the legality of these kind of cheques, evaluation of these cheques by the ban of acceptance, the difference between the confirmed cheques, the situations where the respondent can assert exception, the right of complaint and the termination of the guaranteed cheque agreement are discussed.In the third section, the crossed cheque and elimination cheques as the reliance increasing methods of the drawer and beneficiary are discussed. In this section, under the heading of crossed cheque, the following topics are discussed; the individuals who are authorized to cross the cheque, components of the crossed cheque, generally crossed cheque and specially crossed cheque. Secondly, in this section, the elimination cheques, the individuals who are authorized to prepare elimination cheque, the evaluation of this record in terms of law, the responsibility of the respondent regarding the losses as the outcome of the process and the exceptional situations where cash payment will be demanded will be discussed.To conclude, by the means of this thesis, we believe that we will contribute to the development and improvement of the trade life healthier and safer via introducing the actions to increase the reliability of the cheque to the traders and businessmen.
