Özet
Telif haklarõnõn korunmasõ, teknolojik gelişmeler ile daima ayrõlmaz bir ilişkiiçerisinde olmuştur. Bilim ve teknoloji alanõndaki gelişmeler, bir yandan düşünce vesanat alanõnda yeni atõlõmlarõn gerçekleştirilmesini sağlamõştõr. Diğer yandan ise, bugelişmeler düşünsel yaratõcõlõk ürünlerinin kolaylõkla suiistimal edilebilmesine yol açanyeni imkanlar yaratmõş bulunmaktadõr. Bu anlamda düşünce ürünleri üzerindeki telifhaklarõnõn korunmasõ noktasõnda özel hukuk yaptõrõmlarõnõn yetersiz kalmasõ, cezahukuku yaptõrõmlarõnõn devreye girmesini sonuçlamõştõr. Bu çalõşmanõn amacõ da, Türkhukukunda telif haklarõnõn korunmasõna özgülenmiş ceza normlarõnõ kapsamlõ bir şekildeinceleyebilmektir. Çalõşmada bu amaca ulaşabilmek için karşõlaştõrmalõ hukuktakidüzenlemeler ile de gerek ulusal gerekse ulusal üstü düzeyde, gerekli olduğu ölçüde bazõkarşõlaştõrmalar yapõlmõştõr.

The protection of copyright has always been inseperably linked to technologicaladvance. On the one hand, the advance in science and technology has resulted newimprovements in the field of ideas and art. Yet, on the other hand, this advance has alsogiven rise to the new opportunities of exploiting the works of intellectual creation. Thecivil law remedies have no longer been enough to provide efficient protection oncopyrighted works, this situation resulted in the application of criminal sanctions in thefield of copyright law. And the aim of this study is to analysis in detail the criminalprovisions of Turkish copyright law, which are spesificly focused on the protection oflegal rights of the persons who created the works. In this respect, some necessarycomparisons have been made between the legislations in comparative law both innational and international scale.
