Arrest means to deprive a person of his liberty in a criminal proceeding by legal authority. Arrest involves the authority to arrest, the assertion of that authority with the intent to effect an arrest and the restraint of the person to be arrested. An arrest is lawful when there is a valid warrant commanding it. Arrest warrant is a written order which commands law enforcement officer to arrest a person and bring him before magistrate. The warrant shall be signed by the magistrate and shall contain the name of the defendant, describe the offense charged in the complaint and the reasons of arrest. Mere suspicion or belief, unsupported by facts or circumstances, is in sufficient for an arrest. In effecting an arrest, no more physical force must be used than is reosanbly required; otherwise the arrest becomes an actionable assault. The defendant who is arrested must be brought before the authorized magistrate or court within a specified limit of time. If it is not possible to bring him before this magistrate or court within this specified limit of time, he must be brought before the nearest available magistrate within the same limit of time. As an arrest can not be permenant but is temporary, it should be periodically controlled by the legal authority. During these controlles, if the judge finds out that the reasons and conditions of arrest have become invalid, he should order the liberty of the person. The arrested defendant has the right of habeas corpus. He can claim that the arrest is unlawful before a superior legal authority.
