Özet
ÖZET Bu tezin temel amacı, PKK terör örgütü ile mücadelede askerî gücün kullanılmasını incelemektir. Bu kapsamda çalışmanın hipotezi“Türkiye PKK terör örgütüyle mücadelede hukuk devleti ve hukukun üstünlüğünü ön planda tutmuş ve terörle mücadelede, askerî gücü olan Türk Silahlı Kuvvetlerini bu bakış açısıyla kullanmıştır”şeklindedir. Çalışmamızda ilk olarak terörizm ve terörizmle mücadeleyle ilgili teorik bilgiler verilmiş, müteakiben 1 984 - 2004 yılları arasında Türkiye'nin PKK terör örgütüyle mücadelesi analiz edilmiştir. Çalışmanın sonunda elde edilen sonuç Türkiye'nin PKK terör örgütüyle mücadelede hukukun üstünlüğünü ön planda tuttuğu ve askerî gücünü bu perspektifte kullandığıdır. Türkiye PKK terör örgütüyle mücadelesinde Ceza Adalet Modeli'ni kullanmış ve demokratik bir toplum olmanın gerekliliklerini yerine getirmiştir. Terörle mücadele eden demokratik toplumların karşılaştıkları en büyük sorun kabul edilebilirlik ve etkililik arasındaki dengeyi sağlamaktır. Türkiye Ceza Adalet Modeli'ni uygularken kabul edilebilirlik ve etkililik arasındaki dengeyi korumaya çalışmış ve bunu da başarmıştır. Terörle mücadelede askerî güç kullanırken, güç kullanmada gereklilik ve orantılılık kriterlerine mutlaka uymak gerekir. Kuvvet kullanırken gereksiz acıya neden olmamalı ve masum insanlar mutlaka korunmalıdır. Bu hususlara dikkat edilmediği takdirde, yaptığımız mücadelenin meşruiyetini tehlikeye atabiliriz. Terörle mücadele olağan yönetim usulleriyle mümkün değilse, olağanüstü rejim uygulamalarına geçilir. Terörle mücadelede olduğu gibi, olağanüstü rejim uygulamalarında da dikkat edilmesi gereken en önemli husus kabul edilebilirlik ve etkililik arasındaki dengeyi korumaktır. Olağanüstü rejim uygulanırken hem ulusal, hem de uluslararası hukuk normlarına uygun hareket edilmelidir.

ABSTRACT The main purpose of this thesis is to investigate the usage of the military power in the struggle with PKK terror organization. In this scope, the hypothesis of the dissertation is that“In the struggle with PKK terror organization, Turkey regarded the state of law and the superiority of the law as being a thing of a specified degree of importance and used his armed forces in this perspective”. At first, in our study, theoretical informations about terror and combatting terrorism were given and then Turkey's struggle with PKK terror organization between 1984 - 2004 was analysed. The outcome of the dissertation is that Turkey showed respect for the superiority of the law in his struggle with PKK and used his military power in this perspective. In his struggle with PKK terror organization, Turkey used Criminal Justice Model and fulfilled the necessities of being a democratic society. The biggest problem that the democratic societies face while combatting terrorism is to balance the acceptability and the effectiveness. While using the Criminal Justice Model, Turkey strove for maintaining the balance between the acceptability and the effectiveness and Turkey achieved his purpose. While using military power in the struggle with terrorism, one must obey the criterions of necessity and being proportional. One musn't cause unnecessary pain and innocent civilians must be protected. If these subjects aren't paid attention, we might imperil the legitimacy of the struggle. If it is impossible to cope with terrorism in usual ways, exceptional regimes can be executed. As in combatting terrorism, the most important point that must be paid attention in the executions of exeptional regimes is to protect the balance between the acceptability and the effectiveness.
