SUMMARY We tried to examine the two punishments siystem which much differences between each other their special charac ter in our working. These are islam and Turkish punish ments law;. We know that İslam punishments law; is coming from religion. That is, the source of it is religion. In spite of that, the source of Turkish punishment law is hu man being and it was taken from the west law;; that's from Roman law;, it is accepted that Roman law is a modern law nowadays. So, Turkish Punishment lav; is which comes from Roman law, has been created by the mind and experiment of humanbeing. However, islam lav; has been created by the "od but not humanbeing. Our working has six chapters together with starting and ending. I tried to compare islam and Turkish punishment law wand tried to prove the importamc of punishment law; in the system of law/ in/our startingchapter. İn the first chapter of our thesis, we tried to tell tee production of punishment law, the subject of it, chapters of it, and contents of sources of it, Me examined the dif ferences and same qualities of the both two laws. Also, we tried to prove differences of islam punishment law. In the second chapter, we tried to express the crimes and the mistakes out of the crimes which are accepted by the people. (The mistakes which are not crime) Me tried to tell the production of guilties, the subjects, sorts of it in the crimes chapter. In the third chapter we tried to examine about peonle who get in crime and the wictim. Again in this chanter, we told the reasonof why the crimes have increased so much con- tinualy. After these chapter, we tried to tell about the production of conf irmings, the sorts of punishments, the characters of punishments.Besides, we examined the matters of the ¦ pursoses of punishments, the changessone's mind of punishment, and exe cution and postpane of punishment, And then we tried to pro ve the activity of punishments according to Turkish and Islam law. At the end of this chapter we tried to establish characters of punishments. In this may working I tried to prove the differences of these both laws.
