Özet
Bu tezin amacı, John Locke' un sözleşme kuramının, ne tür bir mülkiyet anlayışına izin verdiğini göstermeye çalışmaktır. Locke 'un sözleşme kuramının ne tür bir mülkiyet anlayışına izin verdiğini ortaya koyan çalışmalarda, zıt sonuçlara ulaşılabildiği görülmektedir. Bu sonuçlardan hangisinin daha doğru olduğunun ortaya kanabilmesi bakımından, öncelikle doğru bir yöntemin seçilmiş olması gerekir. Bu amaçla, bu çalışmada şöyle bir yöntem izlenecektir: Doğa durumu, toplum durumunun izlerini içinde barındıran bir durum olarak düşünüldüğünden, toplum durumu anlayışını ve özelde, toplum durumundaki mülkiyet ilişkilerini anlamak için, Locke' un doğa durumu anlayışına dönülerek, bu döneme ilişkin olarak ne söylediğine bakılacaktır. Bu saptamalar ışığında, toplum durumu anlayışı ve toplum durumundaki mülkiyet ilişkileri çözümlenmeye çalışılacaktır. Bu tezin ispatlanması amacıyla birinci bölümde Locke 'un doğa durumu ve doğa yasası anlayışları incelenecektir. Toplum durumu anlayışı ve toplum durumundaki mülkiyet anlayışının ortaya kanabilmesi için, doğa durumu anlayışının çözümlenmesi gerekir. Bu çerçevede, doğa durumunun bileşenleri incelenecek, doğa durumunun bir barış durumu olup olmadığı; doğa durumunun savaş durumuyla ilişkisinin ne olduğu; doğa durumunun aynı zamanda bir savaş durumu mu olduğu, yoksa belirli dışsal faktörlerin devreye girmesiyle mi savaş durumuna dönüştüğü soruları yanıtlanmaya çalışılacaktır. Birinci bölüm altında incelenecek olan ikinci konu, Locke'ta doğa yasası anlayışıdır. Çalışmanın İkinci bölümünde ilk olarak özel mülkiyet kavramı ve bu kavramın bileşenleri üzerinde durulacak; çalışmanın amacıyla sınırlı olarak mülkiyet kavramının tabi tutulduğu çeşitli ayrımlara göz atılacak ve özel mülkiyet kavramı belirginleştirilmeye çalışılacaktır. İkinci olarak Locke'un bu kavramsal çerçeve içinde nerede durduğunu saptamak açısından, Locke'un doğa durumundaki mülkiyet kavramı çeşitli açılardan incelenecektir. Çalışmanın üçüncü bölümünde, Locke'un toplum durumu anlayışı ve toplum durumundaki mülkiyet anlayışı ortaya konmaya çalışılacaktır. Dolayısıyla, bu bölümün de ana başlık olarak iki alt başlıktan oluştuğu görülecektir. The aim of this study is to show the understanding of property in John Locke's contract theory. It is observed that in studies which show the understanding of property in John Locke's contract theory, some controversial results have been reached upon. To be able to find out which one of these results is correct, one should have chosen the right approach. For this reason, the following method will be followed in the study. Since the state of nature is considered to contain the traces of civil society, to understand civil society and the property relationships of the civil society in particular, Locke's understanding of and statements about the state of nature will be determined. In the light of these, civil society and the property relationships of the civil society will be analyzed. To prove this thesis, Locke's understanding of the state of nature and law of nature will be discussed as the first topic of the first chapter. To be able to determine the civil society and the understanding of property in the civil society, the concept of the state of nature should be analyzed. In this respect, the components of the state of nature will be analyzed to find out whether or not the state of nature is a state of peace, what the relationship between the state of nature and state of war is, whether the state of nature is a state of war as well or, if it becomes a state of war as a result of external factors. The second topic will be Locke's understanding of the law of nature. In the second chapter, the first topic will be about the concept of private property and its components and the different classifications of the concept of property will be discussed to make the concept of private property clear, within the limitations related to the aim of this study. Secondly, to be able to determine the standing of Locke in this conceptual structural frame, Locke's concept of property in the state of nature will be discussed in different respects. In the third chapter, Locke's understanding of the civil society and the concept of property in the civil society will be discussed. For this reason, this chapter will consist of two topics as well, namely, the understanding of civil society and the understanding of property in the civil society. 287
