Özet
ÖZET Avrupa'da, Fransız İhtilalinin doğurduğu siyasi sistem değişiklikleriyle mutlak ve teokratik devletler yerini anayasaya ve meşrutiyete dayalı devletlere bırakmıştır. Osmanlı Devleti'nde ise Tanzimat Döneminde başlayan meşrutiyet mücadelesinin öncülüğünü Yeni Osmanlılar Cemiyeti ve bazı aydınlar yapmışlardır. Bu araştırmada Birinci Meşrutiyet döneminin anayasası olan Kanûn-ı Esâsî'nin hazırlık aşamaları incelenmiştir. Bu çalışmada; anayasayı hazırlamak üzere kurulan komisyon ve bu komisyonun incelediği anayasa taslakları birinci bölümü, Kanûn-ı Esâsî ve meşrutiyete dair hazırlanan lâyihalar ile Kanûn-ı Esâsî'nin son şeklini alması ve ilanı ikinci bölümü, ilk seçimler ve Meclis-i Mebusan'ın açılışı ile meclisin ilk dönem icraatları üçüncü bölümü oluşturmaktadır. Kaynak niteliğindeki eserler ve arşiv belgeleri, Kanûn-ı Esâsî'nin uzman bir komisyon tarafından hazırlandığını, dolayısıyla“Mithat Paşa ve arkadaşlarının hazırladığı anayasa metni II Abdülhamit'e kabul ettirilerek ilan edilmiştir”şeklindeki basit yargının doğru olmadığını ortaya çıkarmıştır. Bu çalışmada; anayasanın ilanından sonra toplanan ilk Osmalı Parlamentosunun farklı din, mezhep ve etnik kökenleri temsil eden milletvekillerinden oluşmasına rağmen, icraatlarıyla Osmanlı toplumunu meydana getiren milletlerin bir arada yaşayabileceğini gösterdiği görülmüştür. in

ABSTRACT In Europe, absolist and theocrotic states left their places into constitution and constitutional monarchy due to the political system changes caused by the French Revolution. New Ottomans Union and some of the intellectual people were the leaders of the struggle of the constitutional monarchy in the era of political reforms which started by the Tanzimat Period in Ottomon State. In this reseach, the preparation stages of 'Kanûn-ı Esâsî' which was the constitution of the first Constitutional Monarchy era is examined. In this work, the first part includes 'the commission formed to prepare the constitution and the constitution drafts examined by this commission' the secont part includes the personel reports prepared about the Kanûn-ı Esâsî and constitutional monarchy and the last shape of Kanûn-ı Esâsî and the declaration of it, the third part includes 'the first elections, the opening of Meclis-i Mebusan and its first period performances.' The sources and the archive documents have proved that Kanûn-ı Esâsî was prepared by an expert commission, so it showed that the simple judgement as 'Mithat Paşa and his friends prepared the constitution and forced II. Abdülhamit to declare it' is not right. In this work, it is proved that, though the first Ottoman Parliament that came together after the decleration of constitution consisted of deputies representing different religions religious sects and ethnic origins, their performances show that the deputies which form the Ottoman society can live together. It is seen that, it shows the deputies who form the Ottoman society can live together through their performances. IV
