Özet
Avrupa Yeşil Mutabakatı (Mutabakat), Avrupa Birliği (AB)'nin iklim nötr ekonomi hedefi doğrultusunda ulaştırma ve denizcilik sektörünü de kapsayan kapsamlı bir dönüşüm süreci başlatmıştır. Bu süreçte AB Emisyon Ticaret Sistemi (ETS)'nin deniz taşımacılığına genişletilmesi, FuelEU Maritime Tüzüğü ve MRV sistemi gibi düzenlemeler, deniz yoluyla taşıma faaliyetlerinin yalnızca teknik ve ticari yönlerini değil, çevresel uyum boyutunu da doğrudan etkileyen bir düzenleyici çerçeve oluşturmuştur. Söz konusu düzenlemeler, özellikle AB limanlarına uğrayan veya AB limanlarıyla bağlantılı seferlerde gemilerin emisyon, yakıt kullanımı, izleme, raporlama ve doğrulama yükümlülükleri bakımından yeni uyum gereklilikleri doğurmaktadır. Çalışmada, Mutabakat kapsamındaki denizcilik düzenlemelerinin, taşıyanın gemiyi sefere elverişli bulundurma borcuna etkisi incelenmektedir. Tezin temel hareket noktası, çevresel uyum yükümlülüklerinin klasik anlamda sefere elverişlilik borcunu doğrudan ve otomatik olarak değiştirmediğidir. Buna karşılık somut seferin özelliklerine göre geminin hukuki ve operasyonel elverişliliğinin değerlendirilmesinde dikkate alınabilecek yeni bir unsur haline gelebildiğidir. Bu çerçevede çevresel uyumsuzluğun her durumda sefere elverişsizlik sonucu doğurmayacağı; ancak ilgili düzenlemenin somut sefere uygulanabilir olduğu, uyumsuzluğun limana giriş, yükleme, boşaltma veya taşımanın ifasını etkilediği ve taşıyanın makul özen yükümlülüğü ile illiyet bağının kurulabildiği hallerde sefere elverişlilik borcu bakımından hukuki sonuç doğurabileceği ele alınmıştır. Çalışmada öncelikle Mutabakat'ın hukuki niteliği, AB iklim politikaları içindeki yeri ve deniz taşımacılığına ilişkin temel düzenlemeler ele alınmıştır. Ardından AB ETS, FuelEU Maritime ve MRV sisteminin deniz taşımacılığı üzerindeki etkileri incelenmiştir. Bu düzenlemelerin sınır aşan uygulama alanı, liman devleti yetkisi ve üçüncü devlet bayraklı gemiler bakımından ortaya çıkarabileceği sonuçlar değerlendirilmiştir. İkinci bölümde ise taşıyanın gemiyi sefere elverişli bulundurma borcu, denize, yola ve yüke elverişlilik ayrımı çerçevesinde açıklanmış; çevresel uyum yükümlülüklerinin özellikle hukuki ve operasyonel elverişlilik üzerindeki etkisi tartışılmıştır. Milletlerarası özel hukuk bakımından çalışma, yabancı unsurlu denizyoluyla eşya taşıma sözleşmelerinde uygulanacak hukukun belirlenmesi, taraf iradesinin sınırları üzerinde durmaktadır. Bu kapsamda MÖHUK m. 24 ve m. 29 hükümleri, sözleşmeye uygulanacak hukukun tespiti bakımından değerlendirilmiştir. AB kaynaklı iklim regülasyonlarının Türk mahkemesi önünde MÖHUK m. 6 ile şartları oluştuğunda MÖHUK m. 31 kapsamında sözleşmeyle sıkı ilişkili üçüncü devletin doğrudan uygulanan kuralları çerçevesinde dikkate alınması hususu tartışılmıştır. Son olarak, çevresel yükümlülüklere uyumsuzluğun taşıyanın sorumluluğu, ifa engelleri, gecikme, tazminat ve sigorta ilişkileri bakımından doğurabileceği sonuçlar incelenmiştir. Çalışmanın sonucunda, Mutabakat kapsamındaki denizcilik düzenlemelerinin taşıyanın sefere elverişlilik borcunu klasik anlamda ortadan kaldırmadığı veya bütünüyle yeniden kurmadığı; ancak deniz taşımacılığının düzenleyici çevresini değiştirdiği ölçüde borcun kapsamının yorumlanmasında etkili olabileceği tespit edilmiştir. Bu nedenle çevresel uyum, taşıyanın sefere elverişlilik borcu bakımından bağımsız ve mutlak bir unsur olarak değil, somut olayın özelliklerine göre hukuki ve operasyonel elverişlilik değerlendirmesine dahil edilebilecek tamamlayıcı bir ölçüt olarak ele alınmalıdır.

The European Green Deal (Green Deal) has initiated a comprehensive transformation process in line with the European Union's (EU) objective of achieving a climate-neutral economy, encompassing the transport and maritime sectors as well. Within this process, regulatory instruments such as the extension of the EU Emissions Trading System (ETS) to maritime transport, the FuelEU Maritime Regulation and the MRV system have established a regulatory framework that directly affects not only the technical and commercial aspects of carriage by sea, but also its environmental compliance dimension. These regulations introduce new compliance requirements concerning emissions, fuel use, monitoring, reporting and verification, particularly for voyages calling at EU ports or otherwise connected with EU ports. This study examines the effects of maritime regulations adopted within the scope of the Green Deal on the carrier's obligation to provide a seaworthy vessel. The main premise of the thesis is that environmental compliance obligations do not directly and automatically alter the classical meaning of the obligation of seaworthiness. Nevertheless, depending on the characteristics of the particular voyage, such obligations may become a factor to be taken into account in assessing the vessel's legal and operational seaworthiness. In this regard, environmental non-compliance does not in every case result in unseaworthiness. However, where the relevant regulation is applicable to the specific voyage, where non-compliance affects entry into port, loading, discharge or performance of the carriage, and where a causal link can be established together with the carrier's duty to exercise due diligence, such non-compliance may produce legal consequences in terms of the obligation of seaworthiness. The study first addresses the legal nature of the Green Deal, its position within EU climate policies and the main regulations concerning maritime transport. It then examines the effects of the EU ETS, FuelEU Maritime and the MRV system on maritime transport, and evaluates the cross-border scope of these regulations, port State jurisdiction and the possible consequences for vessels flying the flag of third States. The second part of the study explains the carrier's obligation to provide a seaworthy vessel within the framework of seaworthiness, voyageworthiness and cargoworthiness, and discusses the effects of environmental compliance obligations particularly on legal and operational seaworthiness. From the perspective of private international law, the study focuses on the determination of the law applicable to international contracts for the carriage of goods by sea and the limits of party autonomy. In this context, Articles 24 and 29 of the the Act on Private International Law and International Civil Procedure (IPPL) are assessed with regard to the determination of the applicable law. The study further discusses whether EU-based climate regulations may be taken into account before Turkish courts under Article 6 of the Act and, where the relevant conditions are met, within the framework of Article 31 as overriding mandatory rules of a third State closely connected with the contract. Finally, the study examines the possible consequences of non-compliance with environmental obligations in terms of the carrier's liability, impediments to performance, delay, compensation and insurance relations. The study concludes that maritime regulations adopted within the scope of the Green Deal neither abolish nor entirely reconstruct the classical understanding of the carrier's obligation of seaworthiness. However, to the extent that they alter the regulatory environment of maritime transport, they may influence the interpretation of the scope of that obligation. Accordingly, environmental compliance should not be treated as an independent and absolute element of the carrier's obligation of seaworthiness, but rather as a complementary criterion that may be included in the assessment of legal and operational seaworthiness depending on the circumstances of the particular case.
