Özet
Akla zarar veren maddeler, insanlık tarihi boyunca bireyi ve toplumu etkilemiş ve bütün hukuk sistemlerine konu olmuştur. Bu tezde İslam hukuku ile mer'i Türk hukukunun hükümleri aklı koruma bakımından mukayese temelli olarak çalışılmıştır. Çalışmanın mukayese kısmına geçmeden önce, ele alınan maddelerin kısa bir tarihçesine ve tanıtımına yer verilmiştir. Daha sonra mukayesenin ilk ayağı olan İslam hukuku kısmında konu,“aklı koruma”hikmeti perspektifinden işlenmiş ve aklî melekeleri bozan katı ve sıvı maddeler, mezhepler arasındaki bazı farklılıkları ortaya koyacak şekilde ele alınmıştır. Çalışmada İslam hukukunda alkol ve uyuşturucuya karşı tutum, önce usûl, ardından dört mezhep ve Zâhirîler esas alınarak furû' boyutuyla incelenmiştir. Günümüzde İslam hukukunun konuyla ilgili hükümlerini ortaya koyan fetva kuruluşları vb. kurumların düzenleme ve fetvalarına da yer verilmiştir. Mukayesenin ikinci ayağı olan mer'i hukuk kısmında öncelik, uyuşturucu maddelere verilmiş, ardından sarhoş edici maddeler ele alınmıştır. Bu alt bölümlerde, söz konusu maddelerle ilgili cezalandırıcı veya kısıtlayıcı yaptırımlar Türkiye'deki hukuk mevzuatı odağında değerlendirilmiştir. Literatürde iki hukuk sistemi arasında bu çalışmanın gerçekleştirmeye çabaladığı mukayeseyi yapan ve konuya aklı koruma ilkesini esas alarak bakan bir çalışmaya rastlanmamıştır. Esas alınan bu önemli ilke ve gaye odağında gerçekleştirilmiş olan çalışma sonucunda, iki hukuk arasında önemli bazı benzerliklere ve kayda değer farklara ulaşılmıştır.

Substances that impair the mind have affected individuals and society throughout human history and have been the subject of all legal systems. This thesis comparatively examines the provisions of Islamic law and current Turkish law in terms of protecting the mind. Before proceeding to the comparative section, a brief history and introduction of the substances under consideration are provided. Then, in the first part of the comparison, Islamic law, the subject is addressed from the perspective of the wisdom of“protecting the mind,”and solid and liquid substances that impair mental faculties are discussed, highlighting some differences between the schools of thought. In this study, the attitude towards alcohol and drugs in Islamic law is examined first from the perspective of methodology, then from the perspective of branches of thought, based on the four schools of thought and the Zahiri school. The regulations and fatwas of institutions such as fatwa organizations that currently provide the rulings of Islamic law on this subject are also included. In the second part of the comparison, current law, priority is given to narcotic substances, followed by intoxicating substances. In these subsections, punitive or restrictive sanctions related to the aforementioned substances have been evaluated within the framework of Turkish legal legislation. No study in the literature has been found that undertakes the comparison between the two legal systems that this study attempts to achieve, and that examines the subject from the perspective of the principle of protecting the mind. As a result of this study, which was conducted with this important principle and aim in mind, some significant similarities and notable differences between the two legal systems have been identified.
