Özet
Günlük dilde çelişme, bir konuda birbiriyle ters düşen fikirlerin varlığını ifade etmektedir. Diyalektik perspektiften ise çelişme, çatışan fikirlerden hareketle (tez ve antitez) senteze ulaşma yöntemini anlatmak için kullanılmaktadır. Yargılama hukukunda çelişme ilkesi, mahkemenin farklı iddialardan hareketle maddi gerçeğe ulaşmaya yönelik diyalektik yönteme benzer bir akıl yürütme sürecini benimsemesi şeklinde tezahür etmektedir. Adil yargılanma hakkının unsuru olan çelişme ilkesi, Avrupa İnsan Hakları Mahkemesi içtihatlarında görece geç dönemde yerini almış bir ilkedir. Bu durum ilkeye ulusal hukukumuzda ancak son yıllarda ilgi gösterilmesini açıklamaktadır. Ülkemizde çelişme ilkesinin etkin biçimde uygulanmasına yönelik yargısal bakış açısının henüz tam anlamıyla yerleştiğini söylemek güçtür. Yargılama sürecine tarafların aktif katılımını amaçlayan bu ilke, gelişen teknolojik imkânlar ve artan hak arama bilinci doğrultusunda, yargılama hukukuna ilişkin pek çok soruna çözüm üretebilecek potansiyele sahiptir. Çelişme ilkesi, tarafların yargılama sürecine katılımını sınırlayan mevcut engellerin ortadan kaldırılmasına hizmet eden etkili bir usul güvencesi olarak değerlendirilmelidir. Çelişme, Anayasa m. 36, Avrupa İnsan Hakları Sözleşmesi (AİHS) m. 6 ve Anayasa m. 138/1 kapsamında mahkemelerin uymakla yükümlü olduğu bir yargılama ilkesidir. Yargı mercilerinin pek çok kararında çelişme ilkesine açıkça ya da üstü kapalı biçimde yer verdikleri görülmektedir. Yargısal sürecin denetimi esnasında çelişmeli yargılamaya yönelik eksikliğin“çelişme ilkesinin ihlali”olarak teşhis edilmemesi, ilkenin yargısal sürece yönelik katkılarından mahrum kalınmasına sebep olmaktadır. Çelişme ilkesi yerine savunma hakkı, hukuki dinlenilme hakkı ve silahların eşitliği ilkesi gibi yargılama hukuku kavramlarının kullanılması, ilkenin kendine özgü işlevlerinin göz ardı edilmesine, bu da yargı mercilerinin çelişme ilkesinden kaynaklanan yükümlülüklerini tam olarak yerine getirememesine neden olmaktadır. Bu doğrultuda çelişme ilkesi açısından var olan eksikliklerin doğru teşhisi, olası çözüm önerilerinin daha isabetli belirlenmesini sağlayacaktır. Çalışmanın amacı idari yargılama hukukunda çelişme ilkesinin uygulanmasının tüm yönleriyle değerlendirilmesidir. Bu amacın gerçekleşmesi bağlamında çalışmada iki aşamalı bir yöntem benimsenmiştir. İlk aşamada çelişme ilkesinin teorik çerçevesi üzerinde durulmaktadır. Bu aşamada çelişme ilkesinin yargılama hukukuna hâkim olan diğer ilkeler içindeki kendine özgü konumu dikkate alınmak suretiyle ölçülü biçimde uygulanmasına yönelik bakış açısının yerleştirilmesi hedeflenmektedir. Bu doğrultuda çelişme ilkesinin yakın ve ilişkili olduğu kavramlar karşılaştırmalı bir bakış açısıyla incelenecektir. İlkenin teorik çerçevesine ilişkin kıyaslamada en önemli kaynak AİHS ve çelişme ilkesine ilişkin Avrupa İnsan Hakları Mahkemesi (AİHM) içtihatları olacaktır. Bununla birlikte, çelişme ilkesini AİHM içtihatlarında benimsenen yaklaşımdan daha ileri düzeyde ele alan çeşitli ülke uygulamalarına da gerekli ölçüde yer verilecektir. Çelişme ilkesinin teorik çerçevesi, ilkenin idari yargıdaki uygulamasının incelenmesi açısından başlangıç noktasını oluşturmaktadır. Birinci aşamada ilkenin işlevi, amacı ve kapsamı konusunda ulaşılan sonuçlardan hareketle, idari yargılama hukukuna yansıması değerlendirilecektir. Şüphesiz idari yargılama hukukunun kendine özgü amaç ve araçları da bu değerlendirmeyi doğrudan ya da dolaylı biçimde etkileyecektir. Bu bağlamda mahkemelerin çelişme ilkesinden kaynaklanan yükümlülükleri, bir yandan maddi gerçeğe ulaşılmasını kolaylaştırmakta diğer yandan hükümden etkilenen kişilerin yargılama sürecine katılımını sağlayarak yargılamaya etkide bulunabilme imkânı sağlamaktadır. Nitekim idari yargıda çelişmeli yargılama süreci, hâkimi hükme götüren unsurların, ilgililerinin bilgisine sunulması ve onlara açıklama yapma imkânı tanınmasını gerektirmektedir. İdari yargıda çelişme ilkesinin, yargılama süreci üzerindeki etki ve sonuçları iki temel boyutta ele alınabilir: İlkenin sağladığı koruma kapsamında olan bilgi ve belgelerin belirlenmesi ile bu güvenceden yararlanacak kişilerin belirlenmesi. Bu doğrultuda çelişme ilkesinin yargılama sürecine yansıması konu ve kişi unsurları açısından ayrı ayrı incelenmelidir. Çelişme ilkesinin konu bakımından kapsamı dava boyunca temin edilen dava malzemesi bağlamında ele alınmalıdır. İdari yargılama hukukunda çelişme ilkesinin konu bakımından kapsamı açısından en kritik sorun, güvence kapsamında olması gereken bilgi ve belgelerin belirlenmesi noktasında karşımıza çıkmaktadır. Bu soruna karşılık iki ihtimal ortaya çıkmaktadır: Çelişme kapsamında ilgililerinin bilgisine sunulması gereken dava malzemesi kanun koyucu tarafından açıkça ya da örtülü biçimde belirlenmiş olabilir ya da ilkenin kapsamında olan bilgi ve belgelerin belirlenmesi yetkisi mahkemelere tanınmış olabilir. Birinci ihtimalde, yani çelişme ilkesinin konu bakımından kapsamının kanun koyucu tarafından belirlendiği durumlarda, mahkemenin sorumluluğu bu belirlemeye uygun şekilde bildirim ve açıklama yapma imkânı tanınmasıyla sınırlıdır. Ancak idari yargılama hukukunda çelişme ilkesinin tesisini ilgilendiren tüm bilgi ve belgelerin mutlak biçimde kanunla öngörülmesi mümkün değildir. Bu durumda birinci ihtimalin eksik kaldığı yönlerin, ikinci ihtimalde aktif bir rol üstlenen mahkeme tarafından tamamlanması gerekmektedir. Bu ihtimalde İdari Yargılama Usulü Kanunu (İYUK) m. 20'de düzenlenen re'sen araştırma ilkesi, çelişme ilkesinin konu bakımından kapsamının belirlenmesinde en önemli etken olarak öne çıkmaktadır. Çelişme ilkesinin kişi bakımından kapsamının belirlenmesinde dava türü, uyuşmazlık konusu, uygulanan yargısal usul gibi çeşitli etkenlerin göz önünde bulundurulması gerekmektedir. Bu bağlamda farklı dava türleri ve yargısal usuller çerçevesinde çözülen uyuşmazlıklarda tarafların, müdahillerin ve taraf ya da müdahil sıfatı taşımayan üçüncü kişilerin çelişme ilkesi kapsamında yararlanması gereken güvenceler bu etkenler doğrultusunda şekillenecektir. Bu bağlamda dava sonucundan etkilenecek kişilerin, çelişme ilkesinin sağladığı güvencelerden belirli ölçülerde yararlanması hakkaniyete uygun bir yargılamanın temel koşulunu oluşturmaktadır.

In everyday language, a contradiction refers to the existence of conflicting ideas on a particular subject. From a dialectical perspective, however, the concept of contradiction is used to describe the method of reaching a synthesis based on conflicting ideas (thesis and antithesis). In the law of judicial proceedings, the adversarial principle — which derives its name from this dialectical notion of contradiction — is embodied in the court's adoption of a process of reasoning similar to the dialectical method, whereby it seeks to arrive at the material truth by considering differing claims. As an element of the right to a fair trial, the adversarial principle is a relatively recent development in the case law of the European Court of Human Rights. This explains why our national law has only begun to take an interest in this principle in recent years. It is difficult to say that a judicial perspective aimed at the effective application of the adversarial principle has yet fully taken root in our country. This principle, which aims to ensure the active participation of the parties in the trial process, has the potential to provide solutions to many issues relating to procedural law, in line with advancing technological capabilities and a growing awareness of rights. The adversarial principle should be regarded as an effective procedural safeguard serving to remove existing barriers that limit the parties' participation in the trial process. The adversarial principle is a procedural principle to which courts are bound under Article 36 of the Constitution, Article 6 of the European Convention on Human Rights (ECHR) and Article 138(1) of the Constitution. It is evident that judicial authorities have explicitly or implicitly incorporated the adversarial principle into many of their decisions. Failure to identify a deficiency in adversarial proceedings during the review of the judicial process as a 'breach of the adversarial principle' results in the loss of the principle's contributions to the judicial process. The use of concepts from procedural law such as the right to defence, the right to be heard, and the principle of equality of arms in place of the adversarial principle leads to the disregard of the principle's unique functions, which in turn prevents judicial authorities from fully fulfilling their obligations arising from the adversarial principle. In this regard, the correct diagnosis of existing shortcomings regarding the adversarial principle will facilitate the more accurate identification of potential solutions. The aim of this study is to evaluate the application of the adversarial principle in administrative procedural law in all its aspects. To achieve this aim, a two-stage method has been adopted in the study. The first stage focuses on the theoretical framework of the adversarial principle. In this stage, the aim is to establish a perspective on the measured application of the adversarial principle, considering its unique position amongst the other principles governing procedural law. In this regard, concepts closely related to the adversarial principle will be examined from a comparative perspective. In this comparison, the adversarial principle will be considered as an element of the right to a fair trial, as enshrined in Article 6(1) of the ECHR. Consequently, the most important sources for the comparative analysis of the adversarial principle's theoretical framework will be the ECHR and the case law of the European Court of Human Rights concerning the adversarial principle. However, due consideration will also be given to the practices of various countries that address the adversarial principle at a more advanced level than the approach adopted in European Court of Human Rights case law. The theoretical framework of the adversarial principle forms the starting point for examining its application in administrative justice. In the first stage, based on the conclusions reached regarding the principle's function, purpose and scope, its reflection in administrative procedural law will be assessed. Undoubtedly, the specific aims and instruments of administrative procedural law will also influence this assessment, either directly or indirectly. In this context, the obligations of the courts arising from the adversarial principle, on the one hand, facilitate the establishment of the material truth and, on the other hand, enable those affected by the judgment to participate in the proceedings, thereby providing them with the opportunity to influence the outcome. Indeed, the adversarial trial process in administrative justice requires that the elements leading the judge to a decision be presented to the parties concerned and that they be afforded the opportunity to provide explanations. The impact and consequences of the adversarial principle in administrative justice on the trial process can be examined in two fundamental dimensions: the identification of the information and documents covered by the protection afforded by the principle, and the identification of the persons entitled to benefit from this safeguard. In this regard, the reflection of the adversarial principle on the trial process must be examined separately in terms of the subject matter and the parties involved. The scope of the adversarial principle in terms of subject matter must be considered in the context of the case materials obtained throughout the proceedings. In administrative litigation law, the most critical issue regarding the scope of the adversarial principle in terms of subject matter arises when determining which information and documents should be covered by the guarantee. Two possibilities arise in response to this issue: the case materials that must be made available to the parties within the scope of the adversarial principle may have been explicitly or implicitly determined by the legislature, or the authority to determine the information and documents falling within the scope of the principle may have been granted to the courts. In the first scenario—where the scope of the adversarial principle in terms of subject matter is determined by the legislature—the court's responsibility is limited to the ability to make notifications and explanations in accordance with this determination. However, it is not possible for all information and documents relevant to the establishment of the adversarial principle in administrative litigation law to be absolutely prescribed by law. In such cases, the aspects where the first possibility falls short must be supplemented by the court, which assumes an active role in the second possibility. In this scenario, the principle of ex officio investigation, as set out in Article 20 of the Code of Administrative Procedure (İYUK), emerges as the most significant factor in determining the scope of the adversarial principle in terms of subject matter. In determining the scope of the adversarial principle in terms of the parties, various factors such as the type of case, the subject matter of the dispute, and the judicial procedure applied must be taken into account. In this context, the safeguards that parties, interveners and third parties not acting as parties or interveners are entitled to under the adversarial principle will be shaped in accordance with these factors in disputes resolved within the framework of different types of cases and judicial procedures. In this context, the fact that persons affected by the outcome of the proceedings benefit to a certain extent from the safeguards provided by the adversarial principle constitutes a fundamental condition for a fair trial.
