Özet
Otomotiv hukukunda motorlu taşıt satış sözleşmesi gereğince motorlu taşıt satışı gerçekleştiren bayilerin alıcılara karşı ayıptan dolayı sorumluluğu söz konusudur. Buna ek olarak üretici, ithalatçı ve yetkili servis istasyonlarının da alıcılara karşı sorumluluğu bulunur. Ancak bu kişilerin ayıptan dolayı sorumlu olabilmesi için motorlu taşıt satış sözleşmesi yapan alıcıların kural olarak tüketici olması şarttır. Tüketici alıcıların ayıptan doğan sorumluluk anlamında daha geniş haklara sahip olmasından dolayı motorlu taşıt satış sözleşmesi yapan alıcının sahip olduğu sıfatın tespiti önem arz eder. Bu kapsamda kural olarak tüketici alıcılar motorlu taşıt satışlarında garanti ve satış sonrası hizmetlerden faydalanma imkanına sahiptir. Buna ek olarak motorlu taşıt satış sözleşmesinde sorumluluğa neden olan ayıbın mevcudiyeti ve niteliğinin tespiti sorumluluğun belirlenmesi açısından önemlidir. Ayıptan dolayı sorumlu olan kişilerin sorumluluğunun doğabilmesi için gereken şartların tamamının bir arada bulunması gerekir. Ayıptan sorumluluk için gereken şartların niteliği alıcının sıfatına göre değişiklik gösterir. Söz konusu şartların gerçekleşmesi durumunda bayi, üretici, ithalatçı ve yetkili servisin alıcıya karşı ayıptan doğan sorumluluğu gündeme gelir. İlgili şartların gerçekleşmesi halinde alıcı, sahip olduğu haklardan dilediğini seçerek ayıptan dolayı sorumlu olan kişilere karşı ileri sürebilir.

In automotive law, dealers who sell motor vehicles in accordance with the motor vehicle sales contract are liable to the buyers for defects. In addition, manufacturers, importers and authorized service stations also have responsibilities to buyers. However, in order for these persons to be liable for the defect, the buyers who make a motor vehicle sales contract must be consumers as a rule. Since consumer buyers have wider rights in terms of liability arising from defects, it is important to determine the title of the buyer who makes a motor vehicle sales contract. In this context, as a rule, consumer buyers have the opportunity to benefit from warranty and after-sales services in motor vehicle sales. In addition, it is important to determine the existence and nature of the defect that causes liability in the motor vehicle sales contract in terms of determining liability. All of the necessary conditions must be present in order for the liability of the persons responsible for the defect to arise. The nature of the conditions required for liability for defects varies according to the title of the buyer. In the event that the aforementioned conditions are met, the responsibility of the dealer, manufacturer, importer and authorized service arising from the defect against the buyer comes to the fore. If the relevant conditions are met, the buyer can choose any of his rights and claim them against the persons responsible for the defect.
