Özet
Hukuk, devlet ve ekonomi ilişkileri, önemli değişimlerin yaşandığı 19. yüzyıl Fransa'sında düşünür Frédéric Bastiat tarafından oldukça açık ve derin bir biçimde tahlil edilmiştir. Liberal iktisadi anlayışın en önde gelen isimlerinden biri olan Bastiat'nın fikirleri; bireysel özgürlükler, doğal haklar, sınırlandırılmış devlet, serbest ticaret ve piyasa ekonomisi kuramlarının ne denli mühim olduğunun anlaşılması bakımından oldukça değerlidir. Hukukun bir çeşit toplum mühendisliği aracı olmak yerine toplumdaki adaletsizlikleri önlemesi ve gidermesi gerektiğini vurgulayan Bastiat; yasal yağmaya ve hukukun yeniden dağıtım amacıyla suiistimal edilmesine karşı mücadele vermiştir. Bastiat fırsat maliyeti yaklaşımını ön plana çıkararak devletin ekonomik eylemlerinin doğurduğu gizli bedelleri gözler önüne sermiştir. Onun fikirleri modern ekonomi kuramını ve politikalarını önemli ölçüde etkilemiştir. Bastiat, sosyalizm ve korumacılığa yönelik eleştirilerde bulunarak bu sistemlerin ekonomik özgürlükleri ve bireysel sorumluluk bilincini tahrip ettiğini ileri sürmüş ve hangi saiklerle olursa olsun devletin ekonomik alandaki müdahalesini reddetmiştir. Minimal devlet varlığını ve mülkiyet hakkının korunmasını savunan Bastiat'nın öğretisi, laissez-faire kapitalizmi çerçevesinde şekillenen bir kişisel hürriyetler kurgusunu en üst düzeyde tutmaktadır. Bununla birlikte ekonomide olumsuz ve istenmeyen sonuçlardan kaçınmak için serbest piyasaya hiçbir şekilde dokunulmamasını vurgulamakta; bireylerin açık ve adil yasalar çerçevesine kendi çıkarlarını özgürce takip edebilmesinin önemini savunmaktadır. Bastiat'nın tüm eserlerindeki ortak payda, devletin olabildiğince sınırlı bir alana hapsedilerek bireylere azami özgürlüklerin tanınması olmuştur. Bastiat'nın gayet anlaşılır analojilerle tasvir ettiği fikirleri, günümüzde toplumun her bir ferdi için faydalı olacak bilgiler barındırmaktadır. Bastiat'nın entelektüel mirasını hukuk, devlet ve ekonomi çerçevesinde incelediğimiz bu çalışma, kendisinin yaklaşık 200 yıl önce ortaya koyduğu ancak güncelliğini hâlâ koruyan fikirlerini Türkçe literatüre taşıyarak kamu hukukunun güncel meselelerine katkıda bulunmayı hedeflemektedir.

The relationship between law, state and economy has been analyzed in a very clear and profound way by the intellectual Frédéric Bastiat in 19th century France, at a time of significant transformations. Being one of the most prominent figures of the liberal economic thought, Bastiat's ideas are highly valuable with regard to understanding the importance of individual liberties, natural rights, restricted state, free trade and market economy concepts. Emphasizing that the law should prevent and remedy existing injustices in society, rather than being an instrument of social engineering; Bastiat campaigned against the legal plunder and the abuse of the law for the purpose of redistribution. By prioritizing the approach of opportunity cost, Bastiat exposed the hidden costs of states' economic actions. His ideas have significantly influenced the modern economic theory and policies. Bastiat was highly critical of socialism and protectionism, arguing that these systems were destroying economic liberties and the sense of individual responsibility, thus he rejected any state intervention in the economic sphere, regardless of its motivations. Bastiat's doctrine, which advocates for a minimal state and the protection of property rights, upholds the highest level of personal liberties within a laissez-faire capitalist scheme. In addition, he stressed that the free market should in no way be interfered with in order to avoid negative and undesirable consequences in the economic sphere, and he defended the significance of individuals being free to pursue their own interests within a framework of clear and fair laws. The common denominator in all of Bastiat's works has been the confinement of the state to the most limited sphere possible and the granting of maximum liberties to individuals. Bastiat's ideas, which he depicts through very straightforward analogies, provide insights that are beneficial for every single member of the society today. This study, which examines Bastiat's intellectual legacy within the framework of law, state and economy, intends to contribute to the current issues of public law by bringing Bastiat's ideas, which he presented nearly 200 years ago but still retain their relevance, to the Turkish literature.
