Özet
Ticaret hukukunu şekillendiren önemli sermaye ortaklıklarından olan anonim ortaklıklarda, pay sahiplerinin ortaklığa özgülemiş oldukları sermayenin akıbetine yön çizmeleri için ortaklık iş ve işlemleri hakkında yeterli derecede bilgilendirilmiş olmaları şarttır. Bilgi alma ve inceleme hakkının bu önemi nedeniyle 6102 sayılı Türk Ticaret Kanunu'nda, hakkın ihlali halinde dava açma imkanı tanınması bu çalışmanın konusunu oluşturmaktadır. Çalışmamız üç bölümden oluşmaktadır. İlk bölümünde bilgi alma ve inceleme hakkı; ikinci bölümde bilgi alma ve inceleme hakkının dava yoluyla kullanılması; üçüncü ve son bölümde ise yargılamaya ilişkin esaslar ele alınmıştır.

In joint stock companies, which are among the important capital partnerships that shape commercial law, it is necessary for the shareholders to be adequately informed about the partnership business transactions in order to direct the fate of the capital they have allocated to the partnership. Due to the importance of the right to obtain and review information, the Turkish Commercial Code No. 6102 provides the opportunity to file a lawsuit in case of violation of the right, which constitutes the subject of this study. Our study consists of three parts. In the first part, the right to obtain and review information; In the second part, exercising the right to obtain information and review through litigation; In the third and last chapter, the principles regarding the trial are discussed.
