Özet
Bu çalışma ile öncelikle, toplumsal hayatın düzenleyici kurallarını belirlemede ve yönetmede söz sahibi olmanın en demokratik yolu olan seçimlerin, amacına uygun olarak daha adil, daha dürüst, daha şeffaf, daha katılımcı şekilde nasıl yapılabileceğine yöntemin belirlenmesi amaçlanmıştır. Seçmen iradesinin sandığa doğru ve eksiksiz bir biçimde yansıması her şeyden önce seçimlerin iyi yönetilmesi ve denetlenmesine bağlıdır. Seçimlerin yönetim ve denetimi kapsamındaki işleyiş, her ülkenin benimsediği ve uyguladığı modele/seçim sistemine göre farklılık gösterebilmektedir. Bu çalışmada seçimlerin ülkelere göre değişen sistemlerine değinilmiş, diğer ülke seçim sistemleri arasında mukayese yapılmak sureti ile Türkiye'de“Seçim Hukuku”çerçevesinde görevli teşkilatın yapısı üzerinden seçimlerin yönetim ve denetim sistemi ayrıntılı ortaya konulmuş, aksayan yönlerin düzeltilmesine katkı sağlanmaya çalışılmıştır. Çalışma, üç ayrı bölümden oluşmaktadır. Birinci Bölümde, seçimlerin genel değerlendirilmesinden sonra seçim hukukuna hakim olan ilkeler açıklanmıştır. İkinci ve Üçüncü Bölümlerde ise Türkiye'de seçimlerin yönetim ve denetim süreçleri ele alınmıştır. Anayasa Mahkemesi ve Yüksek Seçim Kurulu ile Avrupa İnsan Hakları Mahkemesi (AİHM) kararlarından, ayrıca Avrupa Güvenlik ve İş birliği Teşkilatı (AGİT) raporlarından yararlanmak ve Türk seçim teşkilat yapısına değinilmek suretiyle özellikle YSK'nın hukuki statüsü ortaya konulmaya çalışılmış, Türk seçim sisteminin aksayan yönlerine değinilerek çözüm önerileri ve sonuç bölümü sunulmuştur.

With this study, it is primarily aimed to contribute to the effort to reach how the elections, which is the most democratic way to have a say in determining and managing the regulative rules of social life as a requirement of living together, can be held in a fairer, more honest, more transparent and more participatory manner in accordance with the purpose. The correct and complete reflection of the will of the voters in the ballot box depends, first of all, on the good management and control of the elections. The operation within the scope of the management and control of the elections may differ according to the model/election system adopted and implemented by each country. In this study, by referring to the changing systems of elections according to the countries, by providing the opportunity to make a comparison between our country and other country election systems, the management and control system of the elections in detail over the structure of the organization in charge of the“Election Law”in Turkey, and it has been tried to contribute to the correction of the deficiencies. Our study consists of three separate parts. In the First Chapter, after the general evaluation of the elections, the principles governing election law are explained. In the Second and Third Chapters, the management and control processes of the elections in Turkey are discussed. By making use of the decisions of the Constitutional Court and Supreme Election Board and the European Court of Human Rights (HUDOC), as well as the European Security and Cooperation Organization (OSCE) Reports, and by referring to the Turkish election organization structure, the legal status of the Supreme Election Board has been tried to be revealed, and the failing aspects of the Turkish election system have been tried to be revealed. and solution suggestions and conclusion part are presented.
