Özet
Çalışmamızda“Satış Sözleşmesinde Hasarın İntikali, Özellikle Gönderme Satımında Hasarın İntikali”meselesi, Türk-Alman ve Milletlerarası Mal Satım Hukuku (CISG) çerçevesinde karşılaştırmalı olarak ele alınıp incelenmiştir. Roma hukukundan kaynaklanan periculum est emptoris (hasar alıcıya aittir) prensibi, ulusal hukukları etkilemiştir. Söz konusu prensibe göre, hasar, satış sözleşmesi kurulduğu andan itibaren alıcıya aittir. Roma hukukundaki bu prensip, Türk hukuk sistemine aynen alınmıştır; fakat gönderme satımında hasar, mal üzerinde alıcının hakimiyetinin bittiği, malın taşıyıcıya teslim edildiği anda geçmektedir. Buna karşın Alman hukukunda satış sözleşmesinde hasar, malın alıcıya teslim edildiği andan itibaren; gönderme satımlarında ise, malın alıcıya gönderilmek üzere taşıyıcıya teslim edildiği andan itibaren alıcıya geçmektedir. Milletlerarası mal satım hukukuna göre, taraflar, satım konusu malın belli bir yerden alıcıya gönderilmek amacıyla taşıyıcıya verilmesini kararlaştırmamışsa, hasar, alıcıya malın ilk taşıyıcıya teslim edildiği andan itibaren geçer. Buna karşın taraflar malın belli bir yerden alıcıya gönderilmek amacıyla taşıyıcıya verilmesini kararlaştırmışlarsa, hasar, alıcıya malın taraflarca belirlenmiş olan o yerde taşıyıcıya teslimi ile geçer.
Özet (Çeviri)
In our study, the issue of“Inheritance of Damage in the Contract of Sale, Especially the Inheritance of Damage in the Sale of Consignment”is examined comparatively within the framework of Turkish-German and International Sale of Goods Law (CISG). The principle of periculum est emptoris (damage is the responsibility of the buyer), which originated in Roman law, has influenced national laws. According to this principle, the damage belongs to the buyer from the moment the sales contract is concluded. This principle in Roman law has been adopted into the Turkish legal system; however, in the sale of consignment, the damage passes at the moment when the buyer's control over the goods ends and the goods are delivered to the carrier. On the other hand, in German law, in sales contracts, the damage passes to the buyer from the moment the goods are delivered to the buyer; in consignment sales, the damage passes to the buyer from the moment the goods are delivered to the carrier for dispatch to the buyer. According to the international law on the international sale of goods, if the parties have not agreed that the goods subject to the sale shall be entrusted to the carrier for dispatch from a certain place to the buyer, the damage shall pass to the buyer from the moment the goods are delivered to the first carrier. On the other hand, if the parties have agreed that the goods shall be delivered to the carrier for dispatch to the buyer from a certain place, the damage shall pass to the buyer upon delivery of the goods to the carrier at the place determined by the parties.
