Özet
Anayasayı ihlal suçu, halk arasında darbe suçu olarak bilinen suçlardan birisidir. Bu sebeple gündelik hayatta çok sık karşılaşılan bir suç türü değildir. Ancak yakın zamanda, 15 Temmuz 2016'da bu suça teşebbüs edilmiştir. Türkiye Cumhuriyeti tarihinde ise, anayasayı ihlal suçunun neticeye erişilmiş haline iki defa rastlanılmaktadır: 27 Mayıs 1960 Darbesi ve 12 Eylül 1980 Darbesi. Bu darbelerin sonrasında ise, failler işledikleri fiilin ihtilal olduğunu belirtmişlerdir. Nihayetinde ise, failler“İhtilal kendi hukukunu doğurur.”diyerek cezalandırılmaktan kaçınmışlardır. Nitekim öğretide de anayasayı ihlal suçunun neticeye erişmiş halinin cezalandırılamayacağını ifade eden görüşler bulunmaktadır. Bununla birlikte 15 Temmuz 2016 Darbe Teşebbüsü'nde, işlediği fiilin suç olduğunu bilmeyen ve iradi olarak suça iştirak etmeyen askerler, anayasayı ihlal suçu işlemek için araç olarak kullanılmışlardır. Öğretide ise, anayasayı ihlal suçu hakkında hukuka uygunluk nedenlerinin ve kusurluluğa etki eden nedenlerin uygulanamayacağına dair görüşler bulunmaktadır. Ancak uygulama öğretinin tam tersi şekilde gelişmiştir. Hem 12 Eylül 1980 Darbesi failleri yargılanmış hem de 15 Temmuz 2016 Darbe Teşebbüsü'ne dahil edilen emir eri askerler hakkında kusurluluğa etki eden nedenlerin uygulanabileceğine ilişkin kararlar verilmiştir. Bu tez çalışmasında, anayasayı ihlal suçu, içerdiği bu ve benzeri çelişkilere de değinilerek incelenecektir. Çalışmada ilk olarak anayasayı ihlal kavramının ne olduğu, suçun kapsamı açıklanacaktır. İkinci bölümde anayasayı ihlal suçunun eski ve yeni ceza kanunlarındaki ve mukayeseli hukuktaki düzenlemelerine değinilecektir. Devamında ise sırasıyla; suçun konusu, maddi unsurları, manevi unsuru, hukuka aykırılığı, suçun özel görünüş biçimleri; suçun kovuşturulması, zamanaşımı, yaptırımı konuları incelenecektir.

The crime of violating the Constitution is one of the crimes popularly known as the coup crime. For this reason, it is not a frequently encountered type of crime in daily life. However, recently, this crime was attempted on 15 July 2016. In the history of the Republic of Türkiye the crime of violating the constitution, which have been reached to the result is encountered two times: the 27 May 1960 Coup and the 12 September 1980 Coup. After these coups, the perpetrators stated that the act they committed was a revolution. In the end, the perpetrators avoided punishment by saying,“The revolution gives birth to its own law.”. As a matter of fact, there are opinions in the doctrine which expresses that the crime of violating the constitution cannot be punished if it has reached its result. However, in the 15 July 2016 Coup Attempt, soldiers who did not know that the act they committed was a crime and did not voluntarily participate in the crime, were used as tools to commit the crime of violating the constitution. On the other hand, there are opinions in the doctrine that the reasons compliance with laws and the reasons affecting culpability cannot be applied to the crime of violating the constitution. But practice has developed in the opposite way of the doctrine. Both the perpetrators of the 12 September 1980 Coup were tried and decisions were made that the reasons affecting culpability could be applied to the orderly soldiers who were included in the 15 July 2016 Coup Attempt. In this thesis study, the crime of violating the constitution will be examined by referring to these and similar contradictions it contains. In the study, first of all, what is the concept of violating the constitution and the scope of the crime will be explained. In the second part, the regulation of the crime of violating the constitution in the old and new penal codes and comparative law will be mentioned. Afterwards, respectively; the subject of the crime, its objective elements, its subjective element, its unlawfulness, the specific forms of appearance of the crime; the prosecution, statute of limitations and sanctions of the crime will be examined.
