Özet
Bu çalışmada, havâle konusunun Hanefî fürû literatüründeki gelişimi ele alınarak tarihsel süreç içerisinde havâle konusu içerisindeki farklılıkların tespit edilmesi amaçlanmıştır. İki bölümden oluşan bu çalışma kapsamında; ilk bölümde havâle konusunun eserlerdeki konumu ve havâle konusu içerisinde eserlerde ele alınan temel meseleler ve ikinci bölümde ise havâle konusunun eserlerde ele alınış yöntemleri ortaya konulmuştur. Havâlenin ticâri hayatta borç problemine çözüm bulmak noktasında önemli bir yere sahip olması sebebiyle konu, bu mesele üzerinden incelenmiştir. Kaynak olarak el-Asl, Şerhu Muhtasari't-Tahâvî, el-Mebsût, Bedâiu's-sanâi', Tebyînü'l-hakâik, Reddü'l-muhtâr ve Hukûk-ı İslâmiyye ve Istılâhât-ı Fıkhiyye Kamusu isimli eserler kullanılarak havâle konusuyla ilgili değerlendirmelerde bulunulmuştur. Sonuç olarak havâle konusunun zaman içerisinde yeni kavramlarla birlikte detaylandırılarak ele alındığı ve bunda etkili olan unsurların ise aradan geçen uzun zaman ve mekân farklılığı olabileceği değerlendirilmektedir.

This study aims to determine the differences in the debt assignment within the historical process by considering the development of the debt assignment in the Hanafi furu fıqh literature. This study consists of two parts. In the first part, there are information about the position of the debt assignment and the main issues in the works within a context of debt assignment. In the second part, there is information about the methods of handling the debt assignment. Debt assignment has an important role in business life and therefore the topic has been examined around this context. There are evaluations about debt assignment by using the works el-Aṣl, Sharḥu Mukhtaṣar al-Tahāvī, al-Mabsūt, Badāiʿ al-sanāiʿ, Tebyīnu'l-ḥaqāiq, Radd al-mukhtār and Hukūk-ı Islāmiyye ve Istilahat-i Fiqhiyye Qāmusu as a source. In conclusion, it is considered that debt assignment has been discussed in a more detailed way with new concepts because of the long time and the different places.
