Özet
Sınırlı ayni hak olan ipotek hakkının belirli bir süreyle sınırlı olarak tesis edilmesi ve tesis edilen bu sürenin, ipotek hakkı açısından sonuçları incelenmiştir. Bu kapsamda sınırlı ayni hakların süreye bağlanabilirliği, sürenin bu haklar üzerindeki etkisi ile ipoteğin süreye bağlı olarak kurulması, ipotek türleri açısından süre unsuru, çok uzun süreli ipotek tesis edilmesi sorunu, sürenin ipotek üzerindeki etkileri ve süreye bağlı ipoteğin sona ermesi konuları incelenmiştir. Bu inceleme yapılırken 7181 sayılı Kanun'un 19. maddesiyle Türk Medeni Kanunu'na eklenen ve 01/01/2020 tarihinde yürürlüğe giren TMK m. 883/2 hükmü değerlendirilmiş, süreli ipoteğin sona ermesi açısından düzenlemenin ne ifade ettiği belirlenmeye çalışılmıştır.

The establishment of lien, which is a kind of the limited real right, for a certain period of time and the consequences of this established period in terms of the lien were examined. In this context, the establishment of limited real rights to a limited-period, the effect of the period on these rights, the establishment of the lien depending on the period, the period factor in terms of lien types, the problem of establishing a very long term limited lien, the effects of the term on the lien and the termination of the time-limied lien are examined. While making this examination, the provision of Article 883/2 of the Turkish Civil Code, which was added to the TCC with the 19th article of the Law No. 7181 and entered into force on 01/01/2020, has been evaluated and it has been tried to determine what the regulation means in terms of the termination of the lime-limited lien.
