Özet
Günümüz dünyasına baktığımızda, tüketimin hızla artış göstererek devam ettiğini hepimiz net bir şekilde gözlemlemekteyiz. Dolayısıyla tüketicilerin yani bizlerin, sahip olduğumuz hakların farkında olup ve giderek daha da bilinçli olabilmemiz adına bu alana ilginin artmasıyla birlikte, Tüketici Hukuku da son derece önemli hukuk dallarından birisi haline gelmiştir. Bu yüksek lisans tez çalışmasının konusu da, tüketici konumunda olan bizlerin, herhangi bir mağduriyet yaşamaması adına, ayıplı mal konusunda yaşanabilecek sorunlara ilişkin ne gibi seçimlik haklara sahip olunduğu, aynı zamanda üreticinin ve satıcının da ayıplı mal karşısında yerine getirmesi gereken sorumlulukların neler olduğundan oluşmaktadır. Tüketiciyi korurken aynı zamanda da tüketiciler ile onlara mal ve hizmet sunanlar arasında, bazı kurallar çerçevesinde doğru bir denge kurarak, tarafların karşılıklı menfaatlerinin de korumasını sağlamaktır. 6502 sayılı mevcut Tüketicinin Korunması Hakkında Kanun uyarınca ayıplı mal hakkında genel bilgi verilerek, söz konusu defolu üründe hangi niteliklerin bulunmaması neticesinde bu sorumluluğun ortaya çıkacağı durumlar ayrı başlıklar altında incelenmiştir. Tüketicinin sorumluluklarıyla beraber satıcı ve üreticinin de mesul olduğu ve yerine getirmesi gereken yükümlülükler hakkında bilgiler verilmiştir. Tüketicinin ayıplı maldan dolayı sahip olduğu seçimlik hakları mevcuttur. Tüketici sahip olduğu bu haklardan sadece bir tanesini seçebilme hakkına sahip olup, satıcı da tüketicinin bu hakkını yerine getirmekle yükümlüdür. Tüketicinin sahip olduğu söz konusu bu haklar Tüketicinin Korunması Hakkında Kanun ve Borçlar Kanunu kapsamında, iki kanun gereğince de ele alınmış ve ayrı başlıklar altında anlaşılır bir şekilde aktarılmaya çalışılmıştır. Ayrıca tüm çalışma boyunca içerikle ilgili Yargıtay kararları eklenmiş ve konular yaşanan somut olaylar üzerinden desteklenmiştir.

When we look at today's world, we all clearly observe that consumption continues to increase rapidly. Therefore, Consumer Law has become one of the most important branches of law, with the increasing interest in this field so that we, the consumers, are aware of the rights we have and become more conscious. The subject of this master's thesis study consists of what kind of optional rights we have regarding the problems that may be experienced in the issue of defective goods, in order that we, who are in the position of consumers, do not experience any unjust treatment, as well as what responsibilities the manufacturer and the seller must fulfill in the face of the defective goods. While protecting the consumer, it is also to ensure that the mutual interests of the parties are protected by establishing a correct balance between consumers and those who provide them with goods and services, within the framework of certain rules. In accordance with the current Consumer Protection Law No. 6502, general information about the defective product is given and the situations in which this liability arises as a result of the lack of qualifications in the defective product are examined under separate headings. In addition to the responsibilities of the consumer, clear information has been given about the responsibilities of the seller and the manufacturer and the obligations that must be fulfilled. The consumer has optional rights due to the defective goods. The consumer has the right to choose only one of these rights, and the seller is obliged to fulfill this right of the consumer. These rights of the consumer have been dealt with in accordance with both laws within the scope of the Consumer and Obligations Law and have been tried to be explained in an understandable way under separate headings. In addition, throughout the study, Supreme Court decisions regarding the content were added and the subjects were supported through concrete events.
