Özet
Kişinin vazgeçmesi mümkün olmayan haklarından olan kişilik hakları yapısı gereği herkese karşı ileri sürülebilen haklardandır. Kişilik haklarına karşı oluşabilecek saldırılar kişide ağır maddi ve manevi zararlara sebebiyet verebilecektir. Bu sebeple kişilik haklarının korunması ehemmiyet taşıyan bir konudur. İnsan haklarında kişilik haklarının korunması için pek çok ulusal ve uluslararası mekanizma bulunmaktadır. Aynı şekilde işçinin kişilik haklarının korunmasıyla ilgili olarak da pek çok denetim mekanizması mevcuttur. İşverenin, işçi ile arasındaki iş sözleşmesi gereği, işçiyi koruma ve gözetme borcu bulunmaktadır. Türk Borçlar Kanunu'nun 417.maddesi uyarınca işverenin işçiyi koruma ve gözetme borcu kapsamına işçinin kişiliğinin korunması da girmektedir. İşveren, işçiye uygun, güvenli bir çalışma ortamı yaratmak zorundadır. İşçinin, başka bir işçiden, işverenden veya dışarıdan üçüncü bir kişiden gelebilecek her türlü saldırıya karşı korunması işverenin sorumluluğundadır. Aksi takdirde işçi açısından haklı fesih, maddi ve manevi tazminat talep edebilme gibi haklar söz konusu olabilecektir. Bu çalışmada, kişilik haklarının insan hakları içindeki konumunu araştırdıktan sonra, kişilik haklarını koruma mekanizmalarından ve özellikle işçinin kişilik haklarının korunmasıyla ilgili kişisel verilerinin korunması araştırılmıştır.

Personal rights which are among the rights that cannot be waived are among the rights that can be asserted against everyone due to their nature. The violations that may occur against personal rights may cause serious material and moral damages to the person. For this reason, the protection of personal rights is an important issue. There are many national and international mechanisms in the context of human rights at the point of protection of personal rights. Likewise, there are many control mechanisms for the protection of the employee's personal rights. The employer has a obligation to protect and watch over the employee as per the labour contract with the employee. Pursuant to article 417 of the Turkish Code of Obligations, the protection of the employee's personality is also included in the scope of the employer's obligation to protect and watch over the employee. The employer must create a suitable and safe working environment for the employee. It is the employer's responsibility to protect the worker against all kinds of attacks that may come from another employee, employer or a third party from outside. Otherwise, the employee may have rights such as rightful termination, claiming pecuniary and nonpecuniary damages. In this study, after mentioning human rights in general and the position of personal rights within human rights, the protection mechanisms of personal rights and the protection of personal data, especially within the framework of the protection of employee's personal rights, are also mentioned.
