Özet
5237 sayılı TCK'nin ikinci kitap, dördüncü kısım, ikinci bölümünde genital muayene suçu düzenlenmiştir.“Genital Muayene”kenar başlıklı 287. madde, kişilerin vücut bütünlüğü, özel hayatın gizliliği, adliyenin gereği gibi işleyişini korumak amacıyla ihdas edilmiştir. Bu çalışmada genital muayene suçunun detaylı bir analizinin sunulması amaçlanmıştır. Hazırlanan tez iki bölümden oluşmaktadır. Birinci bölümde; genital muayene kavramı üzerinde durulmuş ve bu muayeneye ilişkin mevzuat hükümleri detaylı şekilde incelenmiştir. İkinci bölümde suç tipinin yapısı ve unsurları incelenmiştir. Bu bölümde suç; hukuki konu, maddi konu, fail, mağdur, suçun unsurları (maddi unsur – manevi unsur), suçun ortaya çıkış biçimleri, suçun soruşturulması ve kovuşturulması, yaptırım başlıklarına ayrılarak incelenmiştir. Bu çalışmada genital muayene suçuna ilişkin öğretideki görüşlere, Yargıtay ve AYM kararlarına yer verilmiştir. Bu metotlar izlenirken olması gereken hukuk bakımından yapılması gereken değişikliklere dikkat çekilmiştir.

In the second book, the fourth part, and the second chapter of the Turkish Penal Code numbered 5237, crime of genital examination have been regulated. Article 287, with the margin title“Genital Examination”has created in order to protect to bodily integrity of individuals, the privacy of private life, and the proper functioning of the courthouse. In this study, it is aimed to present a detailed analysis of genital examination crime. The prepared thesis, prepared consist of two parts. In the first part, the concept of genital examination is emphasized and the provisions of the legislation regarding this examination are examined in detail as well. In the second part, the structure and elements of the crime type are analyzed. In this section, the crime is examined under headings. The legal issue, the material issue, the perpetrator, the victim, the elemens of the crime (material element – moral element), the emergence of the crime, the investigation and prosecution of the crime, and the sanction. In this study, the opinions in the doctrine concerning the crime of genital examination and the decisions of the Supreme Court and the Constitutional Court were frequently mentioned. While following this method, attention was drawn to the necessary changes to be made in terms of the ideal law.
