SUMMARY The scope of this study is the right of privacy and its protection in legal basis. The roots of privacy go back to the one of the basic instincts as the researches of antropologists prove. It is also proved that not only human being but also animals lack for the privacy in the nature. The liberal democratic society rises on the individuality and looks for the contribution of the individuals. If the individuals can make no progress of their own personalities, their participation and contribution to the democratic society will decrease and this will end the democratic life in that society. Knowing this fact, all modern constitutions protect the right of privacy. It is also emphasized that the right of privacy is a part of personal rights. We can also, going further, claim that the right of privacy, in its classic formulation the right to be left alone, comes closser than any other right to the essence of liberty itself. The Constitution of 1982 has adopted right of privacy as one of the basic rights. We also see the right of privacy regulated in the European Convention on Human Rights. The right of privacy is protected by both. In the modern times, becoming the fourth power of the democratic society, the media by all means threatens the right of privacy, which mostly becomes an infringement of the right. Another threat comes from the computirization which provides ability for the broad collection and storation of the personal data. Such new infringements proves that the right of privacy is not constant but has new appearences to come out. Legal protection should prevent the right of privacy from such threats and infringements. Legal protection comes out as means of criminal and civil law and legal system seems to be converting itself according to the devolopments in the society.
