The ambit of military objectives has significantly expanded as cyber operations have enabled to target computer data. However, it appears that current interpretation of international humanitarian law (IHL) falls short of conducting digital hostilities since data is not considered as an object within its framework. This leads to a normative void particularly regarding disruptive operations on civilian infrastructure, which degrades the protection afforded to civilian objects under Geneva Conventions and Additional Protocol I. This dissertation seeks to find out whether data can be protected under IHL. To this end, it firstly examines the relationship between violence and application of the IHL. By analysing the permissive and restrictivist approaches, it notes that the application of fundamental IHL principles could be extended to cyber operations as non-violent military operations. Yet, state practice illustrates that attacks are regarded as the main subject of the law of targeting. For this reason, it focuses on the term“attack”and scrutinises Tallinn Manual 2.0 position, it finds that the premise requiring violent consequences relies upon the materiality of objects. Therefore, the second part of this study seeks for a contemporary interpretation of object by applying textual, contextual, and teleological methods to the term object as recognised under Article 31 of the Vienna Convention on the Law of Treaties by referencing to international case law. It concludes that an alternative interpretation of the term object can be accommodated under the existing norms, which can serve better to the aim to protect civilians from the adverse effects of conflicts.
