Özet
İrtifak hakları, mülkiyet hakkının ardından bir taşınmaz üzerinde sahibine en geniş yetkileri sağlamaktadır. Bu yetkiler kullanma veya yararlanma olabileceği gibi her iki hakkı sağlayan irtifak hakları da bulunmaktadır. Herkese karşı ileri sürülebilen bu irtifak haklarından Mecra hakkı ise bir taşınmazın altından veya üzerinden geçen tesisatlar üzerindeki mülkiyet hakkının taşınmaz sahibi yerine hak sahibine ait olmasına yönelik mülkiyet hakkının bütünleyici parçasının bir istisnasıdır. Uygulama da unutulmaya başlanmış olan mecra hakkı gelişen teknolojiyle birlikte kullanım ve kapsamının genişlemesiyle vatan toprağından sağlanan fayda ile ekonomiye yapacağı katkının azımsanmaması gerekmektedir. İşte bu yüzden tezimizin konusu mecra hakkı olarak seçilmiş ve ilk bölümde mecra hakkının tarihçesine değinildikten sonra genelden özele doğru bir anlatım tarzı benimsenerek mülkiyet hakkı açıklanmıştır. Devam eden bölümlerde mecra hakkının çeşitleri, mecra hakkına dair hukukumuzda kabul edilen görüşlerin yanı sıra karşıt görüşlere de değinilerek tarafımızca mecra hakkına dair kapsam belirlenmeye çalışılmıştır. Mecra Hakkı lehtar ve aleyhtarına ait hak ve yükümlülüklerin açıklanmasından sonra hakkın sona erme sebepleri, yöntemleri anlatılmıştır. Mecra hakkına dair yapılan bu bilgilendirmelerin sonunda da tarafımızca gördüğümüz problemler ve bu çözüm önerileri sunulmuştur.

Easement rights give the owner the broadest powers over an immovable property after the property right. These powers can be used or benefited, as well as easement rights that provide both rights. Of these easement rights that can be put forward against everyone, the conduit right is an exception to the integral part of the property right likewise it is over the installations which are under or above an immovable property and belongs to the right owner instead of the real owner. The right of Conduit, which has begun to be forgotten in practice, should not be underestimated with the benefit obtained from the homeland with the expansion of its use and scope with the developing technology and its contribution to the economy. That is why the subject of our thesis has been chosen as Conduit right and after mentioning the history of Conduit right in the first part, a narrative style from general to specific is adopted and explained. In the following chapters, we tried to determine the scope of the Conduit right by referring all the types of it. The opinions accepted in our law as well as the opposing views. After the disclosure of the rights and obligations of the beneficiary and the opponent of the Conduit easement, the reasons and methods of the termination of the right are explained. At the end of these informations about the right to Conduit, the problems we saw and these solution suggestions were presented.
